Council Minutes of 10/1/2002 <br />,,~,~ there is a stretch of roadway on Columbia Road that is in need of sidewalks. He is <br />contemplating going out for bids on three alternatives: north side of Bradley Road, south <br />side of Bradley Road, and Columbia Road. Until the quotes aze received, we will not <br />know if there is enough money in the General Fund or whether it will have to be <br />borrowed funds. <br />Councilman Miller questioned the Mayor regarding the surface of the Springvale pazking <br />lot. A resident called and inquired whether the final coat was down as the surface seems <br />very porous and the storm drains are raised above the surface. There is a concern that <br />freezing water and snow plows could do damage to the surface, and it is a safety issue for <br />people walking in the pazking lot. Mayor Musial said it was not the final coating as the <br />city ran out of money. It has been that way for two to three years. Finance Director <br />Copfer said that because of the renovation project being done to the golf course and club <br />house, the former Service Director had determined that it would be best not to put down <br />the final coating as it might be damaged by the construction equipmerrt. Councilman <br />Miller expressed concern regazding the safety issue of the raised storm drains and <br />possible damage to the surface from freezing water or snow plows. City Engineer <br />Deichmann said that there has not been any significant damage and that it is anticipated <br />that the water will drain through the porous coating. The Mayor agreed to contact the <br />Safety Director and Springvale Facilities Manger regazding the safety issue of the raised <br />storm drains. <br />Law Director Dubelko: 1) On September 18, along with the Finance Director, Safety <br />Director and the city's labor negotiator Gary Johnson, he attended a mediation session for <br />the fire fighter negotiations. Those negotiations aze now tentatively set for fact-finding <br />on November 11. <br />2) On September 23, the Boazd of Control met and awazded the city salt contract to <br />Cargill as the lowest and best bidder. The contract will be for one year with an option for <br />a second yeaz at the city's discretion at the price that was bid. <br />3) On September 24, he provided a memo to City Council regarding Ordinance No. <br />2002-117, the amended appropriations ordinance. He gave an opinion to Council that all <br />three of Council's actions taken at the September 17 meeting, voting to sustain two of the <br />mayoral vetoes and ovemding the third, could be harmonized and all given effect. The <br />ordinance ultimately enacted was a legal appropriation measure under the Charter in the <br />State of Ohio laws. <br />4) On September 25, he attended the live burns conducted by the Fire Department on <br />Butternut Ridge Road. It turned out to be a positive community event as a lot of school <br />children and passing motorists watched the fire fighters as they battled the fires. <br />5) September 26, he issued legal opinion No. 2002-17 on the procedure for exercises of <br />the Mayor's item veto power and the procedure for Council to reconsider such item <br />vetoes. It was important to give some direction on this even though it was the first time, <br />as faz as he knows, that a mayor in this city had exercised an item veto over an <br />appropriation measure. In light of the budget challenges that the city is facing next year, <br />it might came up again. So he provided an opinion to try to guide the Mayor's office and <br />Council if there should be this item veto and reconsideration required in the future. <br /> <br />3 <br />
