Councilman <br />Miller said he understood Mr. Limpert's comment, but would remark that at the <br />committee meetings he did ask that the developer consider a muted yellow and a <br />muted recs. There was something that could have been done if everyone had <br />collectively agreed. $ut he appreciates the comment. <br />^ Ordinance 2002-128 through and including 2002-133 are easements. <br />- Ordinance 2002-128 is an ordinance accepting a water main easement located on the <br />property owned by James & Christine Martynowski and designated as P. P. No. 235- <br />12-091. On this particular piece of property, the water main is just about 2 feet from <br />the home. The city is asking for an easement approximately 12 112 feet from all of <br />the proposed properties. <br />- Ordinance 2002-129, an ordinance accepting a water main easement located on the <br />property owned by David & Kimberly Snyder, P. P. No. 235-12-092. <br />- Ordinance 2002-130, an ordinance accepting a water main easement located on the <br />property owned by May F. Wong, P. P. No. 235-12-054. <br />- Ordinance 2002-131, an ordinance accepting a water main easemert located on the <br />property owned by May F. Wong, P. P. No. 235-12-053. <br />- Ordinance No. 2002-132, an ordinance accepting a water main easement located on <br />the property owned by Ronald W. & Sue Claus, P. P. No. 235-12-100. <br />- Ordinance 2002-133, an ordinance accepting a water main easement located on the <br />property owned by Robert Patton Trust, P. P. No. 235-12-102. <br />These easements will allow the city to move the water main away from some of the <br />homes where it is as close as 2 feet from the property line. The line item for this project <br />is approximately $26,000. After discussion, the committee unanimously recommended <br />approval of all the easement ordinances. <br />Mr. Gateau noted that Mr. Nashar's report did not address the issue of the second Shell <br />gas station at Claque Road. There was to be a later submittal with some modifications to <br />the structure that had been previously discussed. Mr. Nashar agreed and concurred that <br />the issue of the Claque Road Shell gas station was held in committee. <br />Councilwoman Kasler, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The committee met on September 10. Preserrt were all of Council, the Mayor, the <br />Safety Director, the Law Director. The following items were discussed: <br />Ordinance 2002-136 (safety belts) was discussed only briefly pending additional <br />information from Officer Holly to be copied and supplied to all of Council. However, <br />a letter was read from a concerned resident who questioned the wisdom of making a <br />failure to use seat belts a primary violation. She specifically objected to "spoon <br />feeding adults regarding personal safety" but advocated a nuisance fee and warning <br />from officers. Those comments will be discussed again at the next committee <br />meeting with regard. to this issue. Councilman Dailey submitted some information <br />and his feelings on this ordinance as did Councilman Nashar who suggested that we <br />review the additional information as proposed and further suggested that this be <br />considered as a resolution to the state as opposed to an ordinance.
