Council Minutes of 9/3/2002 <br />unanimously. As the amendment caused the resolution to revert back to second reading, <br />Councilman Gazeau moved to suspend the rule requiring three readings. The motion was <br />seconded by Councilman Dailey and passed unanimously. Councilman Gateau moved <br />for adoption. The motion was seconded by Councilman Dailey and passed unanimously. <br />Resolution No. 2002-115 adopted as amended. <br />Resolution No. 2002-121 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the payment of sixteen thousand dollars ($16,000) to the Fraternal <br />Order of Police, Ohio Labor Council, Inc. for distribution to specific officers of the <br />NOPD and in consideration of the settlement of grievances under the collective <br />bargaining agreement and declaring an emergency. Councilman McKay moved for <br />adoption. The motion was seconded by Councilman Nashaz and passed unanimously. <br />Resolution No. 2002-121 adopted. <br />Ordinance No. 2002-104 introduced by Mayor Musial was given its second reading. An <br />ordinance amending Chapter 177 of the City Administrative Code entitled "Community <br />Access," in order to establish nonpublic forums, permitting community organizations to <br />access the City Hall web site for the purpose of positively promoting the welfare and <br />development of North Olmsted, and further to allow access to two specific changeable <br />copy signs owned and operated by the city for the purpose of announcing community <br />events, and declaring an emergency, as amended. Councilman Dailey asked for a point <br />of order from the Law Director. As the ordinance reads, "...City Hall web site for the <br />purpose of positively promoting the welfare and development of North Olmsted...," the <br />word "positively" could be interpreted as different things by different organizations. Are <br />there any provisions in the ordinance to address this problem? Law Directar Dubelko <br />said it was somewhat late in the game to discuss it, but he is satisfied with the language <br />"positively promoting." Councilman Miller moved for suspension of the rule requiring <br />three readings. The motion was seconded by Councilman Gateau. Roll call: Miller, yes, <br />commenting that the ordinance was reviewed by committee and the report given this <br />evening. Roll call continued: Gateau, yes; Kasler, yes; Dailey, yes; Limpert, yes; <br />McKay, yes; Nashar, yes. The motion passed unanimously. Councilman Miller moved <br />for adoption. The motion was seconded by Councilman Gateau and passed unanimously. <br />Ordinance No. 2002-104 adopted. <br />Resolution No. 2002-109 introduced by Mayor Musial was given its second reading. A <br />resolution adopting the budget of the City of North Olmsted for the fiscal year beginning <br />January 1, 2003, and submitting the same to the County Auditor, and declaring an <br />emergency. <br />Resolution No. 2002-123 introduced by Councilman Nashaz was given its second <br />reading. A resolution urging the Ohio General Assembly to study the traffic safety risks <br />associated with elderly drivers in Ohio, and to consider changes to the State's drivers <br />license laws as they relate to drivers over the age of 75 years, and declaring an <br />emergency as amended. Councilwoman Kasler moved for suspension of the rule <br />requiring three readings. The motion was sceonded by Councilman Nashar and passed <br />unanimously.
