Council Minutes of 9/3/2002 <br />,,, for the Law Department to review. The rationale for holding it in committee includes <br />the following issues ar questions: Will the establishment have adequate parking? <br />Will the proximity of the next door gas station and adjoining body shop be a safety or <br />ventilation issue? Have all the various city boards and commissions reviewed the <br />proposed site and what is their recommendation? Can we hold this application for <br />review of these issues, far how long and by what method? Law Director Dubelko <br />agreed to look into these issues and respond to the committee. The members voted <br />unanimously to hold this issue in committee. <br />^ A liquor permit stock transfer for the license held by the Ground Round Ina, located <br />at 24250 Lorain Road. This is for a class D 1, 2, 3, 3A and D6 license. Stock transfer <br />will be to American Hospitality Concepts Inc. of the same address. The Police <br />Department had no objection. The committee voted unanimously to not object to this <br />transfer. Councilman Miller moved that Council have no objection to the stock <br />transfer. The motion was seconded by Councilwoman Kasler and passed <br />unanimously. <br />^ Ordinance 2002-125, an ordinance amending Sections 373.05, 373.06, 373.08 and <br />373.15 and repealing Sections 373.07 and 373.10 of Chapter 373 of the Traffic Code <br />errtitled "Bicycles and Bicycle Registration" in order to better facilitate the issuance <br />of bicycle licenses by the Police Department and to improve bicycle safety in the city <br />and declaring an emergency. Under this ordinance, bicycle licensing fees will be <br />eliminated and officers on patrol, including the bicycle patrol officers, will be <br />authorized to issue bike licenses to those lacking one at no cost to the resident. It is <br />hoped that this new, non-expiring license will assist the department in returning many <br />of the unclaimed bikes that the Police Department retrieves, stores and eventually <br />auctions each year. This ordinance also updates our code to conform with the state <br />code in allowing bicyclists to ride on streets no more than two abreast and prohibits <br />children under the age of 8 from riding bikes on public streets. This ordinance was <br />presented at the request of our Police Department and was unanimously <br />recommended for approval by the committee. <br />^ Resolution 2002-123, a resolution urging the Ohio General Assembly to study the <br />traffic safety risks associated with elderly drivers in Ohio and to consider changes to <br />the state's drivers license laws as they relate to drivers over the age of 80 years and <br />declaring an emergency. This resolution was jointly assigned to the Intra- <br />Governmental Relations and Legislation; Long-Range Planning Committee along and <br />the Public Safety, Health & Welfare Committee. Serving on the Intro-Governmental <br />Committee and present were Councilmen Gateau and Miller. Serving on the Safety <br />Committee and present were Councilmen Miller and Nashar. This resolution will not <br />create a new law but will ask the Ohio General Assembly to review this issue. <br />Councilman Nashar asked that the resolution be passed for the following reasons: <br />There is a growing number of senior citizens on our roadways who are affected by <br />various medications, slower reaction time, physical limitations including motor <br />control and vision concerns, Alzheimer's and dementia generally. Mr. Jim Dolance <br />was asked to speak about this resolution. Mr. Dolance's son was recently killed in a <br />motor vehicle collision on I-90 near Erie involving an elderly driver suffering from <br />dementia who was also killed in the collision.
