Council Minutes of 9/3/2002 <br />above the age of 70 to 75 should be tested in a method which requires the individual <br />,~, to better display their mental and physical abilities and/or limitations. He stated that <br />we should do away with the often "coached" method of the eye test only. Mr. <br />Dolance suggested that the test be administered every two yeazs and should be paid <br />for by the applicant. Further, he feels that there should be an obligation on doctors to <br />report physically and/or mentally incapacitated patients to the state and that <br />caretakers or guazdians be held responsible to disallow those drivers who presem a <br />risk of danger to others on ow roadways. Councilman Gazeau concurred that the <br />current re-testing system is inefficient. He also recommended that the age limit in the <br />resolution be placed at age 75. Concurring with that were Councilpersons Nashaz, <br />Miller, O'Grady and McKay. Mr. McKay was concerned about costs involved. <br />Mayor Musial concwred with placing the age of 75, citing concerns about weaving <br />drivers. Resident Paul Barker inquired about how the issue of failing a test due to <br />anxiety would be addressed. It was felt that the more specific issues of cost, anxiety, <br />number of yeazs before re-testing should be left to the state legislature, that our intent <br />should be to get this issue before the legislature for their review without drafting any <br />specific legislation. It was agreed to amend passage of Resolution 2002-123 by <br />changing the age from 80 to 75. The committee unanimously recommended passage <br />of Resolution 2002-123 as amended under suspension of the rule. Mr. Dolance <br />indicated that he would prefer that the age be amended to 70, but he was is thanld'ul <br />that Council was taking action on this issue with hoped that this one day would <br />become federal legislation. <br />2) The Public Safety Committee met this evening, September 3, to discuss the liquor <br />permit for Pepper Joes at 24532 Lorain. The Law Department recommended that the <br />committee request a 30-day extension to respond to this application based on questions <br />from the August 20a' meeting, and the committee ageed. Councilman Miller moved to <br />authorize the Law Department to request a 30-day extension to respond to the <br />application. The motion was seconded by Councilwoman Kasler and passed <br />unanimously. <br />Councilman Miller, chairperson of the Intra-Governmental Relations and Legislation; <br />Long-Range Planning Committee: 1) The committee met on August 20 to discuss <br />Ordinance 2002-104, an ordinance amending Chapter 177 of the City Administrative <br />Code entitled "Community Access" in order to establish non-public forums permitting <br />community organizations to access the City Hall website for the purpose of positively <br />promoting the welfare and development of North Olmsted, and further to allow access to <br />two specific changeable copy signs owned and operated by the city for the purpose of <br />announcing community everns and declaring an emergency. In attendance were <br />committee members Gateau and Miller and Law Director Dubelko. The Mayor was not <br />in attendance, but he had been asked to contact the Law Director with regard to any <br />issues he may have had with this ordinance. However, since the issue needed to be <br />resolved, and it is in the best interest of the city, the Law Director felt comfortable with <br />going forward with discussion on the ordinance. It was recommended that the ordinance <br />amend language to allow the Mayor to designate individuals to review applications, etc. <br />and the Law Director agreed to amend accordingly.
