Council Minutes of 8/6/2002 <br />Inswance Portability and Accountability Act (HIPA), pending and passed state <br />legislation of interest to municipalities, updates an Section 1983 law, public records <br />law and current topics panel discussions. If any member of Council has any interest <br />in any of these areas, he would be happy to provide the information. <br />^ July 16, a civil action was brought against the city by Southeast Golf Car Company, <br />challenging the city's decision to competitively bid the golf car rental agreemern. <br />The city had awazded the contract, pwsuant to authorization by Council, to the lowest <br />bidder. Southeast was the second low bidder. He prepazed a brief in opposition to <br />Southeast's motion for temporary injunctive relief. The matter was heard on the same <br />day, which is often the case in actions seeking injunctive relief, and actually was <br />settled on that day also when the low bidder (there were only two bidders on the <br />contract) decided that it did not wish to be involved in litigation and withdrew its bid <br />rather than engage in litigation. The city Board of Control subsequently met, <br />permitted the low bidder to withdraw and awazded the contract to the second low <br />bidder, Southeast Golf Car Company, who delivered the golf cars on time for <br />Springvale's opening on August 1. <br />^ On July 16, and subsequently on July 30, he attended two work sessions of the <br />Planning Commission regazding the rezoning of Pazcel E. At the conclusion of the <br />July 30 session, Planning Commission unanimously voted to initiate two ordinances, <br />one rezoning Pazcel E to Mixed Use D Use and the other making changes to the <br />regulations for that district to provide more flexibility for mixed use development and <br />also to protect the adjoining neighborhoods from adverse impacts of development. <br />Council members McKay and Nashaz are sponsoring ordinances on these two matters <br />which will be on first reading tonight. <br />^ On July 17, he attended the first of many July and August meetings with city <br />administrative officials concerning the city's 2002 budget crisis. Other meetings <br />were held on July 18, 22, 24, 25, 26, 29, 30, 31 and August 1. It should be noted that <br />the director's team spent almost 12 hours alone on July 26 assembling <br />recommendations to increase revenues and reduce expenditures for the city. <br />^ On July 18, the U. S. Wallcovering sign finally came down. This was the result of a <br />lot of hard work and persistence on the part of the Law Department and Building <br />Department. Special credit for this should go to Bryan O'Malley, Assistant Law <br />Director, and to Dave Peltz from the Building Department <br />^ July 22, he prepazed a response to a letter from the Friends of the Library criticizing <br />the city's alleged delays in construction of the new library. <br />^ July 23, he completed a memorandum to the Personnel Director regarding application <br />of fair labor standazds regulations on the subject of compensatory time off for city <br />non-bargaining employees. <br />^ July 23, he prepazed for and attended, along with the Finance Director and other <br />administrative officials, a firefighter mediation session which lasted all day. <br />^ August 2, he had a meeting with both judges of Rocky River Municipal Court and the <br />magistrates of that court on the subject of Rocky River Court operations as they affect <br />the City of North Olmsted. <br />^ On August 5, Assistant Law Director O'Malley azgued the case of North Olmsted <br />versus Terrence Reagan in the Court of Appeals. <br />3 <br />
