Council Minutes of 6/18/20Q2 <br />for suspension of the rule requiring three readings. The motion was seconded by <br />Councilman Limpert and passed unanimously. Councilman McKay moved for adoption. <br />.; The motion was seconded by Councilman Limpert and passed unanimously. Ordinance <br />` No. 2002-89 adopted. <br />Ordinance No. 2002-90 introduced by Mayor Musial was given its second reading. An <br />ordinance creating a new Chapter 1369 of the Building Code emitled "Charges for <br />Emergency Municipal Services," and declaring an emergency. <br />Ordinance No. 2002-92 by Mayor Musial was given its second reading. An ordinance <br />authorizing the expenditure of sewer revenue funds in an amount not to exceed sevemy- <br />five thousand dollars to compensate Hennie Homes, Inc., for constructing an oversized <br />sanitary sewer for the Willow Woods subdivision so to enable the city to provide sanitary <br />sewer service to the JEDD area within the Olmsted Township Service Area, and <br />declaring an emergency. Councilman McKay moved for suspension of the rule requiring <br />three readings. The motion was seconded by Councilman Limpert and passed <br />unanimously. Councilman McKay moved for adoption; second by Councilman Limpert. <br />Roll call: McKay, yes; Limpert, yes; Gazeau, yes; Nashaz, yes; Miller, yes; Kasler, yes, <br />with comment that she is voting yes because she think it's appropriate and necessary to <br />serve the residents by providing this additional pipe size. However, she is reluctant <br />because she believes that the cost is extremely high and she is relying on the <br />administration's word that the city is not paying for anything which should be or would <br />otherwise have been the responsibility of Hennie Homes. Roll call continued: Dailey, <br />yes. The motion passed unanimously. Ordinance No. 2002-92 adopted. <br />Ordinance No. 2002-93 was introduced and placed on first reading by Mayor Musial. An <br />ordinance amending the Traffic Control File of the City of North Olmsted to provide for <br />the installation of a traffic signal system at the intersection of Brookpazk Road Extension <br />and Sparky Lane and declaring an emergency. Councilman Gazeau moved for <br />suspension of the rules requiring three readings and committee review. The motion was <br />seconded by Councilwoman Kasler and passed unanimously. Councilman Gazeau moved <br />for adoption; second by Councilwoman Kasler. Roll call: Gareau, yes; Kasler, yes; <br />Limpert, yes; McKay, yes; Dailey, yes; Nashar, yes; Miller, yes, with commem that he <br />has requested information from Traffic Engineer Griffith regazding the study done <br />indicating that this location meets a warrant. Since Mr. Griffith has been on vacation, he <br />is repeating that request even though he is voting yes. He feels that the ordinance is <br />appropriate, but he does want to see the study and the numbers. The motion passed <br />unanimously. Ordinance No. 2002-93 adopted. <br />Resolution No. 2002-94 was introduced and placed on first reading by Mayor Musial. A <br />resolution authorizing the payment of twenty-seven thousand three hundred twenty <br />dollars and forty-six cents. ($27,320.46) to Calfee, Halter & Griswold LLP for legal <br />services rendered in connection with the termination of the USEPA consent decree. <br />15 <br />
