Council Minutes of 5/8/2002 <br />~ engineering services for the new North Olmsted branch library; further, authorizing the <br />Mayor to ewer into an agreemem with the firm selected in the RFP process; and <br />declaring an emergency. Councilman Miller for suspension of the rules requiring three <br />readings and committee review; the motion was seconded by Councilman Limpert. Roll <br />call: Miller, yes; Limpert, yes; Dailey, yes; Kasler, yes; Nashar, yes; Gareau, no; <br />McKay, yes. The motion passed with six yeas and one nay. Resident Dennis Lambert, <br />25057 Carey Lane, spoke on the ordinance as it was being passed under suspension of the <br />rules. He asked how the geotechnical data would be used and whether it had anything to <br />do with any of the systems that operate within the library. Mayor Musial said it was <br />specifically to determine the terrain under the surface of the ground upon which the <br />library is to be positioned. The site survey is covered by Ordinance 2002-61. Mr. <br />Lambert said he felt the three pieces of legislation were bad because they basically <br />authorize the Service Director to request a proposal for services. He can do that without <br />an ordinance as long as it does not cost anything. Also, he feels there are two issues <br />covered in the legislation as they authorize the Mayor to enter irrto an agreement without <br />any knowledge of how much it is going to cost. He believes the city should get the <br />proposals and then bring them to Council and Council should review the cost and then <br />authorize the agreement. Doing it the proposed way is not a check and balance. Mrs. <br />Kasler commented that she had raised those issues during caucus. Her vote on <br />suspension of the rule is basically because of the substance and the necessity to move <br />forward. However, her vote was also contingent upon her request that this process be <br />reviewed in committee. Law Director Dubelko said he felt that this is clearly not a <br />violation of the two-subject rule. Councilman Miller moved for adoption, and the motion <br />was seconded by Councilman Limpert. Roll call: Miller, yes; Limpert, yes; McKay, yes; <br />Nashar, yes; Kasler, yes; Gareau, yes, noting that his comments with respect to <br />Ordinance 2002-61 are also incorporated into this vote. Roll call continued: Dailey, yes. <br />The motion passed unanimously. Ordinance No. 2002-62 adopted. <br />Ordinance No. 2002-63 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Director of Public Service to request proposals for thermal <br />conductivity testing services for the new North Olmsted branch library; further, <br />authorizing the Mayor to enter into an agreement with the firm selected in the RFP <br />process, and declaring an emergency. Councilman McKay moved for suspension of the <br />rules requiring three readings and committee review; the motion was seconded by <br />Councilman Nashar. Roll call: McKay, yes; Nashar, yes; Miller, yes; Limpert, yes; <br />Dailey, yes; Gateau, no; Kasler, yes, with the same reservation stated for 2002-62 which <br />will also apply to 2002-61. The motion passed with six yeas and one nay. Resident <br />Dennis Lambert, 25057 Carey Lane, spoke on the ordinance as it was being passed under <br />suspension of the rules. He said he would wholeheartedly recommend that this go to <br />committee and not be passed on emergency. This boring has nothing to do with the <br />library; it has nothing to do with heating systems. He does not believe the city is required <br />to give the library an elaborate system of bells and whistles--only duct work and a <br />conventional heating and cooling system. He suggested the library get the information <br />together and then the city can decide whether they want to go with it or not. Mayor <br />Musial commented that the purpose of this particular ordinance is to put a hole in the <br />ground 300 feet deep to ascertain what the thermal conductivity is of the soil.
