Council Minutes of 5!8lZ002 <br />~, to discuss various issues: (1) Updating and advising on the status of the geotechnical and <br />site survey data RFP's and Council approval thereof. (2) Review of official project <br />schedule. (3) Discussion on the sanitary sewer system and storm drainage system <br />adjacent to the library site. (4) Review of the existing North Olmsted storm drainage <br />ordinance and the city's preliminary estimate for sizing the construction costs for the <br />storm drainage system for the new library. (5) Review of the azchitects schematic <br />documents. (6) A discussion of concerns of the library matrix and construction design <br />process. The administration has been working with Spice, Constantino Architects, the <br />construction manager H. R. Gray, and representatives of the library in establishing a <br />timeline for the construction of the library. This timeline is scheduled to be finalized by <br />the end of May and plans are to have it posted in Council's caucus room so that everyone <br />will have an opportunity to see how the library is progressing. The scheduled completion <br />date for the library is February 2004. <br />Law Director Dubelko: 1) On April 26, the Law Department filed the appropriation <br />action authorized by Council with respect to the proposed public roadway for the <br />proposed RTA Pazk-n-Ride. Notice was received from Probate Court that a hearing has <br />been set for May 22 before Judge John E. Corrigan on the city's motion for a quick take. <br />2) The Law Departmem is a bit closer to being completed. The law library is being <br />assembled and is almost complete. Council members are welcome to stop by to see it. <br />Also, he has been conducting interviews for a city law clerk who will work 35 hours per <br />week and part time thereafter during the school year. Hopefully, someone will be hired <br />before June 1, which will complete the staffing of the city Law Department. <br />3) The legal work for the proposed termination of the EPA consent decree is almost <br />complete. The city has negotiated down the fines that were to be paid to the U. S. EPA <br />and Ohio EPA. Those checks have been cut by the Finance Department and have been <br />submitted to the city's special legal counsel. Today he was informed that the unopposed <br />motion to terminate the consent decree was filed with the district court. Within the next <br />several weeks, the court wilt review the motion and presumably approve it. He will keep <br />Council informed on the status of the court approval. This is almost the culmination of a <br />lot of good work by several people in the city administration over the last several years. <br />He would give a lot of credit to former Law Director Michael Gareau who did a great <br />deal of work on this and equally to Dennis Long who is the city's current environmental <br />engineer. Because of his background with the federal government side of the issue and <br />his background of engineering, he did an excellent job of putting the city in the position <br />to resolve this matter. <br />5) The third fire fighter arbitration has been decided in favor of the city. This grievance <br />and arbitration involved a claim as to whether the city should pay overtime for lunch <br />periods to fire fighters who are on 8-hour training days away from the fire station. The <br />arbitrator concluded that the city was not required to pay them overtime compensation <br />under the Fair Labor Standards Act nor under the express terms of the collective <br />bargaining agreement. <br />6) Adding to the Mayor's report with respect to the master contract form process that is <br />being reviewed, the conract forms are being standardized. The first one that has been <br />standardized is the professional services form. The direction that he is trying to advise <br />the city to move in is to standardize the process of awarding these professional service <br />~- <br />2 <br />r~ ., ~.~,k,.....,.~...~q,. ~,,~,,...,w,~,~ .... . <br />
