Council Minutes of 4/16/2002 <br />McKay moved for adoption. The motion was seconded by Councilman Limpert and <br />passed unanimously. Ordinance No. 2002-28 adopted. <br />Ordinance No. 2002-37 irnroduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor to erner into a contract for the purchase of a portion of <br />the True North Energy, LLC (Shell Oil), property located at 23385 Lorain Road, North <br />Olmsted, Ohio (Permanem Parcel No. 237-09-004) for the purpose of widening Claque <br />Road. Councilman McKay moved for adoption. The motion was seconded by <br />Councilman Nashaz and passed unanimously. Ordinance No. 2002-37 adopted. <br />Ordinance No. 2002-39 introduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor to purchase a portion of the BP Products of North <br />America, Inc. property located at 23425 Lorain Road, North Olmsted, Ohio (Permanent <br />Pazcel No. 237-08-001) for the purpose of widening Claque Road. Councilman McKay <br />moved for adoption. The motion was seconded by Councilman Limpert and passed <br />unanimously. Ordinance No. 2002-39 adopted. <br />Ordinance No. 2002-40 irnroduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to consent to a sublease <br />between AT&T Wireless PCS, Inc. and Sprintcom, Inc., providing for Sprintcom, Inc. to <br />collocate on the monopole at Claque Pazk, and further authorizing the Mayor to enter into <br />a ground lease with Sprirncom, Inc. to provide a site at Claque Pazk for the construction <br />of a service building to house wireless telecommunications equipment associated with the <br />use of the monopole, and declaring an emergency. Councilman McKay moved for <br />adoption. The motion was seconded by Councilman Limpert and passed unanimously. <br />Ordinance No. 2002-40 adopted. <br />Ordinance No. 2002-43 introduced by Councilman McKay and Mayor Musial was given <br />its third reading. An ordinance authorizing the transfer of three (3) storm sewer <br />employees from the Service Department to the Waste Water Treatment section of the <br />Public Works Division, and further authorizing the payment of their wages from the <br />Sewer Revenue Fund, and declaring an emergency. Councilman McKay moved for <br />adoption; second by Councilman Limpert. Roll call: McKay, yes; Limpert, yes, with <br />comment that he thinks it's imperative that Council pass this so that we insure that the <br />advances that have been made in abating flooding problems in our city stay and that we <br />do not recede back into the problems we had of the past. Roll call: Kesler, no, with <br />comment that there has been a proposal to increase the efforts toward cleaning the <br />drainage ditches. She fully and wholeheartedly supports that effort. However, the sole <br />question before Council with Ordinance 2002-43 is out of what fund will the employees <br />be paid. Previously, there were three employees who performed this work and are now <br />going to increase their efforts based on the recommendation of the administration. <br />Again, she agrees with that. The employees were previously paid out of the General <br />Fund, and the ordinance authorizes paying them out of the Sewer Revenue Fund. She <br />disagrees with that payroll change and would like to see the work go forward without <br />further taxing the Sewer Revenue Fund. For the past three years, she has asked for sewer <br />reduction or a plan to reduce the sewer rates. Without seeing that plan, she has a difficult <br />10 <br /> <br />
