Cauncit Minutes of 4/16/2002 <br />,,, AUDIENCE FARTI ATI N <br />Bob Hughes, 18705 Rockland, Cleveland, Ohio, suggested that volunteers be asked to <br />help the City of North Olmsted. Also, he suggested that the residents donate $1 per <br />month to help the city. His family once lived in North Olmsted and that is why he has <br />taken an interest in the city. He has a special concern for the children. He suggested that <br />people who have been laid off come in and voh~nteer their help at the swimming pools. <br />As the city gets stronger, they will be able to pay the volunteers. All this can be <br />accomplished with God's grace. <br />LEGI3~~,QN <br />In consideration of the Mayor's veto of Ordinance No. 2002-51, Councilman Gareau <br />made a motion to reconsider Ordinance No. 2002-51. The motion was seconded by <br />Councilman Miller. Roll call: Gareau, yes; Miller, yes; Limpert, no; Kesler, yes; Nashar, <br />yes; Dailey, no; McKay, yes. The motion passed with five yeas and two nays. President <br />O'Grady put the question to Council, "Shall Ordinance No. 2002-51 be adopted <br />notwithstanding the veto of the Mayor?" Roll call: Kesler, yes; Dailey, no; Miller, yes; <br />Nashar, yes; Limpert, no, with comment that he agreed with the Mayor's veto. This <br />question has been addressed with Ordinance 2002-20, a proposal Charter amendment. <br />He believes Ordinance 2002-5 l is just simply a matter of trying to tip the scales of public <br />opinion to promote the Charter amendment which has been passed by Council. To some <br />it seems that facts are not important, but he believes Council should take no action to <br />repeal 97-122 urnil the people have had a chance to vote and then their will should be <br />carried out at that time. Roll call corninued: McKay, yes; Gareau, yes, with comment <br />that the Charter as preserrtly written addresses the issue of overriding vetoes in terms of <br />elected members of Council eligible to vote. He is an appointed member of Council and, <br />at least on the face of the Charter as it has been understood by him, his vote is not to be <br />counted toward overriding a veto. However, he makes this vote because he does have an <br />obligation to vote. He has discussed this with the Law Director, and it is his obligation to <br />vote an matters put before the Council. He votes yes to override the veto understanding <br />that his vote will not be applied toward the total number of four which is necessary to <br />override the veto. Law Dir~or Dubelko said that he concurred with the method in <br />which Mr. Gateau has voted. He has the obligation to vote. However, the way the <br />Charter is written, his vote does not count with respect to determining whether or not the <br />Mayor's veto should be overridden. The motion passed with four yeas and two nays. <br />(Per the City Charter, Mr. Gateau's vote cannot be counted but is recorded.) Ordinance <br />No. 2002-51 is adopted notwithstanding the Mayor's veto. <br />Ordinance No. 2002-28 introduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into an agreemern <br />with the Greater Cleveland Regional Transit Authority (GCRTA), providing for GCRTA <br />to pay all casts associated with the acquisition of certain real property in the city, known <br />as Permanent Parcel Nos. 235-12-004 and 23b-11-017 (part), for a roadway to lead to the <br />proposed GCRTA Park-n-Ride facility, and further all costs for the construction, <br />maintenance, and repair of the said roadway, and declaring an emergency.
