Council Minutes of 4/2/ZQ02 <br />Councilman Miller noted that, quite a while ago, he had asked the Mayor if the school <br />zone in that area could be extended to include that intersection. He was told that it was a <br />work in progress. He wondered about the status of that. Mayor Musial said he believed <br />that has been approved, but will get confirmation on it. Service Director Thomas said he <br />did not have an answer, but he will find out and report to Council. Mr. Miller requested, <br />if it has been approved, that moving the school zone signs be expedited. Service Director <br />Thomas agreed. <br />Janet Saringer, 23336 5toneybrook Drive: <br />• She is concerned about Ordinance 2002-40 and asked if this was going to be higher or <br />lower than the original pole and will there be health hazards for children and <br />residents. It took us long time to get that park looking like it is today, and she would <br />hate to think that there is any additional health risk. It's supposed to be a playground. <br />Also, she is concerned about whether another service building will be constructed. <br />President O'Grady noted that this is an issue of collocation. Mr. Limpert responded <br />that this plan does conform with what was originally discussed when the original <br />monopole was passed. It is going to be on the existing monopole, on the height that it <br />was, when the original pole was planned, at the 120 foot mark. The material will be <br />within the fenced area. Mrs. Kesler explained it is not an additional pole, but this <br />antenna will be attached at the highest level of 120 feet. The original amenna is at <br />100 feet. Mr. Limpert noted there is a third unused location at the 80 foot level. By <br />having this collocated on that pole, it eliminates the possibility of more poles, more <br />facilities, more antetittas on top of buildings. It's going to be one place or the other, <br />and this way it puts it in a place where it's for the common good. Mr. Gareau said the <br />final location of the building will be presented to the Planning Commission and BZD <br />Committee for approval. <br />• Regarding Ruby Tuesday's, Mrs. 5aringer asked if they were going to have a liquor <br />license, and Mr. Nashar answered yes. Mrs. Saringer asked if it conformed to the <br />regulations regarding the proximity of a school. Mr. Nashar said it conforms to the <br />state regulations. Law Director Dubellco explain, once constiudion begins, the <br />state will be requved to notify any school or church located within 500 feet and the <br />church or school can object then if they have grounds for objecting. There are <br />different opportunities for different bodies to register objections based on different <br />factors. With respect to a church or a school, as he understands it, and he spoke with <br />an attorney down at the Division of Liquor Contraol, the church or school would have <br />to demonstrate that having a liquor permit at that location would interfere with the <br />processes of the school or the church. He was told that that is a pretty heavy burden <br />to meet just for a restaurant with a liquor license. But that is the law, and they have <br />an opportunity to object to the license. Mr. McKay said that he had been in contact <br />with St. Richard's Church and they had no objections. <br />Jacgi Templeton, 24054 Vincent Drive, the president of the North Olmsted Friends of the <br />Library. She co-chaired the committee to pass the levy issue for the new library that was <br />passed by the voters in November of 2000. She and others are in attendance to support <br />the passage of Ordinance 2002-38, hiring a construction manager for the new library <br />project. They are all very excited about the new library and anxious to see the project <br />11 <br />
