Council Minutes of 2/6/02 <br />~, President O'Grady declared the abstention to be permitted and declazed Mr. Scazl as <br />City Council's appointment to the Recreation Commission. Councilwoman Kesler <br />challenged the decision of the chair to make it a final vote on the abstention being <br />appropriate when it does not appear to fall within the categories of an appropriate <br />abstention. The challenge was seconded by Councilman Limpert. Roll call on the <br />question, "Shall the decision of the chair stand": Kesler, no; Limpert, no; Dailey, yes; <br />Nashaz, no; McKay, no; Gareau, no; Miller, no. The decision of the chair was <br />ovem~led by a vote of 6 to 1. President O'Grady inquired of the Law Director as to <br />whether Mr. McKay's abstention was permissible. The Law Director said the <br />question is whether or not he has cask a proper vote. If Mr. McKay wishes to abstain, <br />he should state the reason for his abstenrtion. Councilman McKay said he had <br />abstained because he did not hear the recommendation of the committee. <br />Councilman Miller said the committee had recommended Mr. Kelley, and <br />Councilman McKay said he would then vote for Mr. Kelley. A discussion ensued as <br />to whether the original motion as made by Councilman Miller and seconded by <br />Councilman Gazeau had been properly voted upon. Councilman Miller called for the <br />question on his original motion. President of Council O'Grady asked him to restate <br />the motion. Councilman Miller moved that Council, pursuant to the recommendation <br />of the committee, appoint Mr. Kelley to a position on the Recreation Commission for <br />the term of 1/1/42 to 12/31/06. The motion was seconded by Councilman Gazeau. <br />Roll call: Miller, Kelley, yes; Gareau, yes; Dailey, no, with comment. Both <br />candidates were exceptional and both are well qualified to serve. He feels that Mr. <br />Scarfs commitment to the Recreation Commission for all these years does set him <br />apart as a candidate of his choice. He hopes that Mr. Scan will cominue to be <br />involved as he has for years, just not in the official capacity. Roll call continued: <br />Nashar, yes; McKay, yes, with comment. In the past, it has been his practice that the <br />recommendation of the committee would weigh strongly on his decision. He has not <br />always agreed with the committee's decision, but in this case he does. Roll call <br />continued: Limpert, no, noting that he echoed the comments of Mrs. Kesler and Mr. <br />Dailey. Roll call continued: Kesler, asked if no other nomination was going to occur <br />and President of Council O'Grady said not if this motion was passed. Mrs. Kesler <br />said she would vote no with all due respect to the committee and based on her <br />previous commems. The motion passed with four yeas and three nays. Mr. Kelley is <br />Council's representative to the Recreation Commission. <br />2) Councilman Miller continued his committee report with several re-appointments to <br />various boazds and commissions: <br />• Councilman Miller moved that Council re-appoint Mrs. Lois Van Auken to the <br />Landmarks Commission for a term of 1/1/02 to 12/31103. The motion was seconded <br />by Councilman Nashaz. Roll call: Miller, yes; Nashar, yes; McKay, yes; Limpert, <br />yes; Kesler, yes; Gazeau, yes, commenting that Mrs. Van Auken is an incredible asset <br />to the city with what she brings to the table and her commitment to the Landmazks <br />Commission. She has many times taken her knowledge of the city's history into the <br />schools for presentations to the students. Roll call continued: Dailey, yes.
