'Council Minutes of 1/15/2002
of powers issue; the question of whether or not attorney-client privilege would be
~, violated. Per the report of the Law Director during the caucus, this is not a separation of
powers issue. There is some overlap in the legislative function in that the Mayor does
have veto power. Secondly, attorney-client privilege is not applicable. This is because
any legislative request immediately becomes a public document. There was clarification
offered that perhaps attorney-client privilege wasn't the issue but personal preference.
There was a concern raised as to whether or not this would generate significantly more
paperwork, and the majority of Council has voted not to issue separate copies as copies
are available in the Clerk's office.
Councilman McKay, chairperson of the Finance Committee: 1) The committee met on
January 14. Present were committee members Limpert, and McKay; Council members
Miller, Dailey, Nashar; President of Council O'Grady; Mayor Musial, Law Director
Dubelko, Finance Director Copfer. Agenda items were as follows:
• Ordinance 2002-1, an ordinance authorizing and directing the crediting of certain
interest and other investment earnings to the General Obligation Bond Retirement
Fund. The city sets aside money to provide for the payment of the general obligation
debt service, and this money earns interest and would ordinarily be placed in the
General Fund. Since before 1990, this money has been directed to the General
Obligation Fund Retirement. The committee believes that this practice is appropriate
and fiscally prudent and wishes that this ordinance be confirmed to ratify the
practice.
• Ordinance 2002-5, an ordinance amending the composition of the Department of
Law. The composition would be as follows: the Director of Law, who shall be the
head of the department; two Assistant Law Directors, a legal secretary, and a law
clerk, all of whom shall be appointed by the Law Director. One Assistant Director of
Law shall be a full-time position to assist the Law Director and also assist the City
Prosecutor. The other Assistant Law Director shall be part-time and act as the City
Prosecutor along with other duties. The legal secretary shall be a full-time position
and shall be the secretary to the Law Director. The city law clerk shall assist the Law
Director in his duties and be paid on an hourly part-time basis. The committee
recommended approval.
• Ordinance 2002-6 which sets the salary ranges for the Law Departmen positions as
follows: Assistant Director of Law in the year 2002, $65,911; 2003, $67,888. City
Prosecutor in 2002, $34,124; 2003, $36,178. Legal secretary in 2002, $35,806; 2003,
$36,880. Law Clerk in 2002, $15 per hour; 2003, $15.45 per hour.
