Council Minutes of 1Z/Z/2003 <br />band from North Olmsted High School and a choir from the high school will entertain. <br />There will be refreshments served. Everyone is invited to attend. <br />Law Director Dubelko: 1) Negotiations for fire fighters, police officers, correction <br />officers, dispatch and bus line employees are in full swing and have taken up most of his <br />time for the past two weeks. <br />2) On November 20, he attended a meeting in Rocky River Municipal Court regarding <br />the state's new traffic code that goes into effect on January 1. The Mayor and the <br />Finance Director were there as well as the City Prosecutor. Consistent with this change <br />in state law, he has already recommended to Council, and Council has appropriated the <br />funds to do a limited recodification of our local traffic code by January to reflect these <br />state law changes. There was some discussion at this meeting at the court as to whether <br />the member cities will in a wholesale fashion incorporate all of the state law changes, or <br />incorporate most of them and retain some differences in their local codes. The Law <br />Department is studying that issue and will make recommendations to Council prior to the <br />time that Council acts legislatively upon the recodification. <br />3) On November 24, he received correspondence from Gary Ebert, Bay Village's Law <br />Director and counsel for the Westshore Council of Governments. COG is currernly <br />studying a proposal to build and implement a regional fire dispatch system utilizing space <br />at St. John Westshore Hospital. Mr. Ebert asked that all of the surrounding law directors <br />review an RFP document which had been prepared by COG's consultant for the <br />design/build of a dispatch cerrter at the hospital and then comment upon the same. He <br />will be responding to Law Director Ebert and will essernially note to him that, subject to <br />approval of the North Olmsted City Council, the City of North Olmsted, if it chooses, <br />may legally participate in the project. This issue is not presently before the City Council. <br />4) On November 24, he served as a judge in Council President O'Grady's middle school <br />classroom. His students were re-creating the famous Boston massacre trial in which five <br />Colonials were killed by British soldiers. As always, he appreciates Council President <br />O'Grady's invitations to bring members of the city government into his classroom to <br />assist in the educational process. <br />5) On November 24, he received a memo from Assistant Law Director O'Malley <br />advising that the city has collected $7,500 of the amount it settled upon with Salim <br />Suleiman arising out of a traffic accident and damage to city property. This settlement <br />was approved by Ordinance 2003-113, The amount we have received thus far is from the <br />insurance company, and it represents the policy limits. There is still a balance due from <br />the defendant, which must be collected, if at all, directly from him. The Law Department <br />will monitor this situation. <br />6) On November 26, along with the FOP's representative, afact-finder was chosen for <br />the police collective bargaining negotiations. He received a notice of this appointment of <br />the fact-finder today. It should be noted, as a result of amended Substitute HB 95 <br />effective June 27, 2003, SERB no longer pays any portion of the fact-finding and the <br />parties now have to bear the entire cost. Perhaps once again the state is moving in the <br />direction of solving its own financial difficulties by increasing our financial difficulties. <br />7) Today he received notice from IMI,A, the Irnernational Municipal Lawyers <br />Association, that the United State Supreme Court had decided two cases that have <br />implications for municipal corporations, One is an ADA decision, the other is a Fourth <br />2 <br /> <br />
