Council Minutes of 9/2/2003 <br />residents are required to only cut back 20 feet of a large lot that is undeveloped. <br />However, residents are responsible for the treelawn in front of their property. Law <br />Director Dubelko said that at a previous meeting he had suggested, if the Service <br />Director contemplated requiring that cutting be done and if he had any legal <br />questions, the Law Dept. would look at the issue. There may be a difference between <br />cutting treelawns on a residential street and being responsible for cutting large <br />portions of the state right-of--way. The issue has not been brought to him by a <br />member of the administration, but he would hope that would be done before any <br />notices are issued to the residents so that we are sure it is within the city's authority. <br />Mr. Pangrac said he was not talking about a treelawn. His mother's property is on <br />Grace Road, and they are paying extra money to the lawn service company to <br />maintain an area on the north side of that property which is owned by the State of <br />Ohio. They received a letter from the city that said they had to cut that area, and they <br />have been doing so. He does not feel that they should have to maintain property <br />owned by the State of Ohio. He noted that property further down Brookpark Road <br />was not being maintained. <br />^ He would like the city to save the older building at the corner of Porter and Lorain <br />which formerly housed Rebecca's Flower Shop and suggested the city research the <br />process used by Olmsted Falls to maintain their historical buildings. Councilman <br />Gareau agreed that Olmsted Falls had been able to keep their older buildings and <br />were also able to have newly built construction architecturally in line with the <br />existing buildings. He has been involved with the Landmarks Commission for most <br />of his time on Council and drafted legislation to try to give the Landmarks <br />Commission more power to preserve these types of buildings. He believes the <br />problem in our city is simply a lack of interest. Law Director Dubelko noted that the <br />owner of the building had offered to give it to the city. However, the city must find a <br />new site and provide the money to move it to that site. He was provided with <br />landmarks district legislation from Cleveland and plans to review it to see whether <br />there may be ideas for ow city to give more "teeth" to ow ordinances. <br />2) Jim Bwns, 3978 Dover Center, expressed some concerns about Ordinance 2003-120. <br />He believes the legislation should provide for some process or policy to give verification <br />of announcements and/or postings, especially on the city website which is maintained by <br />the city and not by a third party. He would like the city to publish the website so that the <br />residents would know and be able to find relatively easily the city's website so they <br />would have access to these notices. <br />LEGISLATION <br />Ordinance No. 2003-47 introduced by Council Members Nashar and Gareau was given <br />its third reading. An ordinance to establish a new and revised procedure for development <br />plan review and to authorize the assessment of costs for expert consultation by amending <br />Sections 1126.02, 1126.03, and 1126.04(d) of Chapter 1126 of the Planning and Zoning <br />Code entitled "Commercial and Other Building Permits," as amended. Councilman <br />Nashar moved for adoption. The motion was seconded by Councilman Gareau and <br />passed unanimously. Ordinance No. 2003-47 adopted. <br />6 <br />
