Council Minutes of 8/19/2003 <br />expenditure with respect to the interior signage can be made without competitive bidding <br />"``~ after September 26 when a new state law goes into effect which raises the competitive <br />bidding limit up from $15,000 to $25,000. However, the audio-visual expenditure must <br />be competitively bid. He was not presented with any information which would support a <br />legal opinion that this latter expenditure could be classified as one that would be excepted <br />from competitive bidding requirements of the City Charter. <br />9) On August 19, he attended again a Boazd of Control and directors' meetings. The <br />Boazd of Control meeting was afollow-up on the August 12 meeting. At that meeting, <br />the city's construction manager was present and explained a proposed $11,000 change <br />order regazding the new library. It involves an enhanced fire alarm system which has <br />been recommended by both the Building Dept. and the Fire Dept. It would provide, in <br />the event a fire alarm went off, that the HVAC equipment would shut down upon the <br />alarm going off rather than waiting for smoke to gather to shut it off. It's not absolutely <br />required by the building code, but it was a recommendation by both the Building and Fire <br />Department and seems well worth the expense. <br />10) Recently, the Ohio Supreme Court decided a case involving the City of Springboro <br />closing a property owner's curb cut to a state route for safety and traffic flow purposes. It <br />was determined not to be a taking requiring the city to compensate the property owner as <br />the property owner was given alternative access to that state route 207 feet down the road <br />through another private property owner's property as a result of the city obtaining an <br />easement from the other owner. This shouldn't be viewed as a signal to begin closing <br />down dangerous curb cuts in the city, but it does show that, if a city plans well to replace <br />curb cuts for safety and traffic reasons, a court is going to look cazefully before deciding <br />that there has been a taking. This is a good decision for municipal corporations. <br />Finance Director Copfer: 1) RITA's reconciliation of July, which is actually the first <br />receipt in August for RITA collections, income taxis .6% over plan, which equates to <br />about forty-six thousand dollars to the General Fund. <br />2) For budgeting purposes, she has begun looking at the tax abatement issues for Moen <br />and MAC to start planning and defining when exactly and how much the city will receive <br />when those companies go back on the tax duplicate for a hundred percent of their taxes. <br />She is being assisted by the County Department of Development. It is a difficult task <br />because the early agreements dating back to the 1990's didn't define cleazly any <br />requirements of stipulating when a company actually occupied the facility and when they <br />became operational in that new building. She is trying to research those dates with the <br />help of the county and will report to Council and the Tax Incentive Review Council when <br />more accurate information is available. <br />3) She has completed the alternate tax budget, and it is before Council on first reading. <br />This is a new format, and it's kind of abig-picture overview of the funds although the <br />debt service is still in a detailed format. <br />4) She has campleted the draft of the annual information filing which is due at the end of <br />September. This is the required filing on an annual basis with the agencies that maintain <br />our debt service. <br />5) She and Personnel & Administrative Services Director Farver met with the city's <br />worker's comp representatives. They aze asking if the city is interested in entering the <br />Ohio Public Treasurers' Association workers' comp risk pool. One of the benefits is the <br />5 <br /> <br />
