Council Minutes of 8/19/2003
commits a wrongful act, i.e. false arrest, false imprisonment or entering a wrong
home. Property and scheduled equipment, provides coverage for the city buildings
and equipment and equipment in the buildings. The coverage is most commonly
needed when damage results from lightning or high wind. Crime, provides coverage
if any money is stolen. Comprehensive liability, is a general coverage similar to the
homeowners' coverage. This would cover damage from sewer back-ups, injuries
resulting if a visitor slips and falls. Auto liability and physical damage, provides
property and bodily injury covered in the event if an accident occurs in the city and
it's the city's fault. Public official errors and omissions, provides coverage for libel,
slander, zoning, employee practices and Title 7 Civil Service violations. Electronic
Data Processing, provides coverage for system breakdowns. Boiler and Machinery,
covers HVAC, electrical mechanisms, for example, chilling apparatus for the ice
rink. Liquor liability, protects the city in the event of an incidem resulting from
serving alcohol at Springvale. The umbrella coverage provides coverage above the
other liability policies, general liability, wrongful acts, auto and employee benefits
liability. Mr. Barker questioned if insurance for terrorism against the Waste Water
Treatment Plant was included. Mrs. Farver explained that damage to the plant was
more of an environmental nature and was of a lower priority than those of personal
injury. The committee recommended approval of Resolution 2003-116.
^ Mr. Dial questioned the progress of Lorain Road repair. City Engineer Durbin
explained that the repair of the pipes and catch basins below the surface was an
extensive piece of work. But the improvement would progress more rapidly because
the lanes will be placed down two lanes at a time. Two lanes are completed from
Stearns to the city line, and it's a very nice job.
Councilman Nashar, chairperson of the Building, Zoning and Development Committee:
1) The Building, Zoning and Development Committee met on August 12. Present were
committee members McKay, Gareau and Nashar; Council members Miller, Kasler,
Dailey; Building Commissioner Conway, Service Director Driscoll, City Engineer
Durbin, Personnel Director Farver, Law Director Dubelko and Mayor Musial. The
following items were discussed:
Home Depot. Consideration was given to the residems who live behind Home Depot
at Country Club Condominiums. Some residents said they were not properly notified
of the Home Depot proposal to expand the storage area in the rear for the garden
cerrter. Many issues were raised from noise level, dust, trucks arriving all hours of
the night and an unkempt area. The residents are disturbed by all the retail stores in
the vicinity behind them with continuing violations which they feel are not being
addressed. After lengthy discussion, the committee recommended to hold Home
Depot in committee and refer this matter back to the Planning Commission to be
revisited. Mr. Mike Collins, the store manager, said that he would take this matter
back to corporate and ask them to review the proposed plans. The Clerk of
Commissions will notify the Country Club Condominiums Association of the
Planning Commission meeting where this issue will be heard.
Informal hearing by North Olmsted Schools for their request to erect a
telecommunications tower to be located on the southwest corner of the North Olmsted
7
