The committee asked for <br />additional mounding and trees. Mr. Greenberger did indicate that he would be more <br />than willing to add additional trees to that area, but the committee felt that they would <br />like to address this with Westfield when they come in with their proposal. <br />Councilman Nashar made a motion to approve the proposed building for Jared <br />Jewelers subject to the recommendations of all the boards and commissions. The <br />motion was secanded by Councilman Gareau. Roll call: Nashar, yes; Gareau, yes, <br />with comment that he would be bringing the matter back, as Mr. Nashar said, to the <br />attemion of Westfield shopping centers to discuss additional trees on the area just east <br />of the building on the north property line to an area all the way just west of the main <br />point of ingress and egress off Brookpark Road and also possible mounding and <br />shrubs because that area is really just one open to asphalt and a parking area. <br />Westfield will be coming back with an additional project in the near future, and these <br />issues will be discussed in that context as well. Roll call continued: Kasler, yes; <br />Dailey, yes; Limpert, yes; Miller, yes; McKay, yes. The motion passed unanimously. <br />Councilman Dailey, chairperson of the Transportation Committee: 1) The Transportation <br />Committee met on Tuesday, June 24, to discuss Ordinance 2003-104, an ordinance <br />amending Sections 373.06, 373.08 and 373.15 of Chapter 373 of the Tragic Code entitled <br />"Bicycles and Bicycle Registration" in order to make language corrections to certain <br />sections of the Chapter and to amend other sections to .improve bicycle safety in the city, <br />and declaring an emergency. In attendance were committee members Dailey and <br />McKay; Council members Limpert, Gareau, Nashar and Kasler; Law Director Dubelko, <br />Mayor Musial. This ordinance was introduced by Councilwoman Kasler, and she <br />deferred to Law Director Dubelko to discuss the changes. The changes made are as <br />follows: 1) Cyclists are no longer required to dismount and cross their bikes at <br />intersections; 2) Bicyclists are now required to obey and follow all traffic laws and <br />signals as do motorists. Also poirrted out is that changes were made to the section <br />allowing minors to ride in the streets. Children under the age of 7 are not allowed to ride <br />in any city street. Minors over the age of 8 may ride on any residential side streets, and <br />minors over the age of 12 are allowed to ride on streets that are not residential. Also, <br />bikes aze to be licensed at no cost. The committee unanimously recommended approval. <br />LEGISLATION <br />Ordinance No. 2003-99 inrtroduced by Mayor Musial was given its second reading. An <br />ordinance dispensing with the RFP process otherwise required by Sections 111.03 et seq. <br />of the Administrative Code and authorizing the Mayor to enter into a second agreement <br />with Floyd Browne Associates, Inc. ("FBA") for the purpose of creating an expanded <br />sanitary sewer master plan for additional developing areas within Olmsted Township, and <br />declaring an emergency. Councilman Limpert moved for suspension of the rule requiring <br />three readings. The motion was seconded by Councilman Gareau and passed <br />unanimously. Councilman Limpert moved for adoption.
