Agenda items were as <br />follows: <br />^ Ordinance 2003-92, which amends Section 1359.01 (d) and 1359.99 of the Building <br />Code, entitled respectively "Definitions" and "Penalty" and further creating new <br />Sections 1359.08 and 1359.09 of the Building Code, entitled respectively <br />"Information to be Provide Regarding Unoccupied Commercial Building" and <br />"Property Maintenance Bond," in order to regulate unoccupied commercial buildings, <br />to enable the Building Commissioner to cause the abatement of nuisances, and <br />declaring an emergency, as amended. This ordinance will further regulate <br />unoccupied commercial buildings so as to authorize the Building Commissioner to <br />cause the abatement of such nuisance conditions, to initiate corrective actions <br />including expenditures of maintenance bonds and for immediate proper maintenance. <br />The owner of the property shall in all cases be responsible for performing and liable <br />for all costs associated with the expense incurred to maintain the unoccupied <br />buildings and the premises following the vacancies and pursuant to the requirements <br />of this chapter. The cost of this bond will be $1,000. The committee recommended <br />approval. <br />^ Ordinance 2003-93, which is an ordinance amending Section 721.04, 721.05, 721.06 <br />and 721.07 of the Business Regulation Code entitled "Temporary Business License; <br />Fee and Duration," "Location of Temporary Place of Business," and "Deposit for <br />Cleaning Premises," in order to further regulate the outdoor storage and sale of goods <br />from commercial parking areas, to restrict commercial tent and sidewalk sales, and <br />declaring an emergency, as amended. This ordinance covers the scope of outdoor <br />storage and sales of goods from within the parking lot area and tents and the <br />sidewalks in the commercial areas within the city. In order to do so, a temporary <br />business license will be required. This will be at a cost, of anon-refundable, $100. <br />This would be submitted to the Safety Director. It is recommended that this <br />ordinance still be reviewed, and it's going to be held in committee for further study. <br />^ Carnegie Management and Development, with Mr. Berryhill addressing Parcel E. <br />This is a parcel that is zoned for Mixed Use, which is retail, office and cluster <br />housing. Mr. Berryhill noted that the plan calls for 70% retail and 30% cluster <br />housing. They are proposing a 125,000 square foot store under one roof, and the Law <br />Director advised the Building, Zoning and Development Committee that this is a <br />preliminary land use site plan and that the zoning should not be considered at this <br />time. After lengthy discussion, the BZD Committee recommended approval of the <br />preliminary land use site plan with a disclaimer that the square footage of the building <br />is not to be included in the discussion and that the proposal be sent to the Building <br />Department and then on to the Board of Zoning Appeals. Councilman Nashar made a <br />motion to approve the preliminary land use plan. The Law Director explained that <br />the preliminary land use plan was approved by the committee with a disclaimer that <br />what is being approved is the location of uses on the property and anything involving <br />public streets and it does not include the percentages.
