Council Minutes of 6/3/2003 <br />water is being drawn from. As you move away, the water table will then rise. It is <br />`~ somewhat of a bowl shape. Mrs. Kasler asked if this is a situation in which Mr. Daily <br />would build his own home-with the water higher than the floor level. There was a long <br />pause, and he indicated that he would prefer not to if at all possible. However, it's done <br />frequently and, through use of the sump pumps, hopefully there would be minimum <br />impact to the integrity of the building structure. The concern was what would happen if <br />there was a power outage. Mr. Daily acknowledged that flooding is a possibility at the <br />new library site; however, there are plans for an emergency generator to be located <br />outside the building at ground level. As a result of this meeting and because of concerns <br />with consistency with what was observed and what the committee was told about the <br />volume of water, Mr. Miller has sent a letter on behalf of the committee to the Mayor <br />asking that the water be tested to determine if in fact it is spring water or rain water that is <br />saturating through the ground. If it is well water, the concern may be that these sump <br />pumps may always be running because spring water is nearly continuous for all practical <br />purposes. Mr. Daily advised that in worse case scenarios he has even seen buildings float. <br />If a building were built on too much water and not porous enough where the water <br />couldn't escape, something like that could happen. He is not indicating that is the case at <br />this site. However, the committee felt that it would probably be in the city's best interest <br />to have a test done without hold-up of the project. It was noted that there were no lost <br />working days due to rain, and Mr. Daily indicated that there are no allowances in the <br />contract for lost days due to rain. Although, when you do bid on a job of this size, you <br />work it into your numbers to anticipate that might happen. He also indicated that there <br />may be a minor change order due to some soil that was unsuitable for use on the site that <br />will need to be hauled away. The committee asked that construction meeting minutes be <br />provided to Council by the Mayor or by Mr. Daily. <br />^ Ordinance 2003-33, an ordinance providing for the submission to the electors of the City <br />of North Olmsted of an amendment to Article III, Section 5 A of the Charter of the City <br />of North Olmsted to require that mayoral appointments of directors be subject to <br />confirmation by a majority of the members of Council. Mr. Dubelko indicated that <br />Council should be, in this scenario should it happen, constant in their awareness of their <br />job responsibilities and the Mayor be constantly aware of his job responsibilities. Article <br />III states: "The Mayor shall be the chief executive officer of the city. He shall supervise <br />the administration of the city's affairs and shall exercise control over all departments and <br />divisions. He shall be the chief conservator of the peace within the city. He shall cause <br />alt laws and ordinances to be enforced." It's clear that the Mayor retains power in this <br />situation in the appointment of directors. To support that, one amendment was <br />recommended that atwo-thirds vote of Council be required to not approve the <br />appointment of a director. That would asswe that there would be very strong reason for <br />Council not to approve any director that the Mayor has chosen. The committee <br />recommended approval with the above-mentioned amendment. The ordinance will go on <br />second reading at the next Council meeting. <br />AUDIENCE PARTICIPATION <br />Richard Jesse, Safety Director, read two letters into the record: 1) The first letter was sent by <br />him to the Recreation Commissioner and staff: "Participants in this weekend's ice show <br />presented outstanding performances.
