Council Minutes of 6/3/2003 <br />Ordinance No. 2003-43 introduced by Councilman Gareau was given its third reading. An <br />~~~ <br />' ordinance creating new Sections 121.05 and 121.06 of the Administrative Code, entitled, <br />respectively "Formal Council Hearings" and "Contempt of Council" so as to authorize the <br />City Council to conduct formal hearings regarding matters within the pubic health, safety and <br />welfare, as well as to hear complaints from citizens of the community regarding the <br />operations of the city government, and further to provide for penalties for contempt of <br />Council, as amended. Councilman Gareau moved for adoption, and the motion was <br />seconded by Councilwoman Kasler. Roll call: Gareau, yes, Kasler, yes; Limpert, no, with <br />comment that he cannot in good conscience vote for this because the requests that he has <br />given for answers to questions on how this can be used for residents have been left <br />unanswered. Tonight just prior to the meeting, Mr. Gareau told him that this afternoon an e- <br />mail was sent with at least some answers if not all the answers to those questions. He looks <br />forward to reading those answers later this evening. One concern was there was no provision <br />to address the concerns of a minority group of Council. Roll call continued: McKay, yes; <br />Dailey, yes, commenting that, after much discussion, he very happily votes yes. Roll call <br />continued: Miller, yes; Nashar, yes. The motion passed with six yeas and one nay. <br />Ordinance No. 2003-43 adopted. <br />Resolution No. 2003-77 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the Mayor of the City of North Olmsted to enter into a new <br />maintenance agreement with Climate-Tech, Inc., providing for HVAC maintenance at Fire <br />Station Number One for cone-year period, and declaring an emergency. Councilman <br />McKay moved for adoption. The motion was seconded by Councilman Nashar and passed <br />unanimously. Resolution No. 2003-77 adopted. <br />Ordinance No. 2002-180 introduced by Council Members Miller, McKay, Nashar and Kasler <br />was given its second reading. An ordinance amending Section 171.07 of Chapter 171 of the <br />Administrative Code of the City of North Olmsted, entitled "Secretary to Housing <br />Council/Tax Incentive Review Council," in order to place the position under the office of the <br />Director of Finance, and declaring an emergency. Councilman Nashar moved to table. The <br />motion was seconded by Councilman Miller and passed unatumously. Ordinance No. 2002- <br />180 tabled. <br />Ordinance No. 2003-2 introduced by Councilman McKay was given its second reading. An <br />ordinance amending Section 1501.1901 of the City Taxation Code in order to reduce the tax <br />credit for residents of the city who earn income in another municipality from one hundred <br />percent (100%) to seventy percent (70%), and declaring an emergency. Councilman McKay <br />moved to table. The motion was seconded by Councilwoman Kasler and passed <br />unanimously. Ordinance No. 2003-2 tabled. <br />Resolution No. 2003-79 introduced by Mayor Musial was given its second reading. A <br />resolution authorizing the Mayor of the City of North Olmsted to enter into an agreement <br />with Browning Ferris Industries of Ohio, Inc. ("BFI"), consenting to BFI's assignment, for <br />securitization purposes, of its right to receive payment under its solid waste collection and <br />disposal, and recyclable materials collection and processing contract with the city, and <br />declaring an emergency. <br />16 <br /> <br />
