Council Minutes of 5/7/2003 <br />..• 8) On April 25, he issued a legal memo to the Mayor regarding having Class 4 licensed <br />' operators operating the WWTP. <br />9) On Apri129, he issued legal opinion 2003-5, which addressed the issue of when a city <br />official may demand a legal opinion from the Law Director. Essentially under state law <br />as adopted in our Charter, the Law Director must provide legal advice to city officials <br />when requested when the official is acting in his or her official capacity in a matter before <br />him or her and when he or she entertains doubts regarding how to proceed in the matter <br />legally. <br />10) On April 29 and May 5, he attended directors' meetings held by the Mayor. They <br />were both very productive meetings, and he is hopeful that the directors' team will <br />continue to meet on a regular basis to address important city issues in a comprehensive <br />manner. He is always impressed by the richness of discussions on city issues, and he <br />believes it assists the administration in resolving problems quickly and effectively for the <br />benefit of residents. <br />11) On April 30, the Records Commission met. The meeting was chaired by the Safety <br />Director who did an excellent job of identifying issues that the city should be concerned <br />with and subsequently delegating assignments to the various members of the commission. <br />There are numerous records issues that require the city's attention and possibly legislative <br />action by Council. <br />12) The Board of Control met regarding three contracts. <br />13) The Ohio Supreme Court ruled on the case of Shampton v. the City of Springboro. <br />This is apro-municipality case which reaffirms that private parties may not hold cities to <br />contracts that were not approved in the manner required by the city's charter. <br />Finance Director Copfer: 1) The month-end March reports are not yet available as the <br />work involved with the re-direction of funds is not completed. <br />2) The auditors have been on-site since April 24 doing their GAAP testing. Our filing <br />deadline for the Comprehensive Annual Financial Report is June 30. <br />3) She has distributed to Council copies of the related-party questionnaire, which is <br />standard protocol every year for Council and all directors who have served during 2002. <br />4) She met with the former Service Director, Mayor, Law Director and the Joint <br />Economic Development District (JEDD) board members. (JEDD is the economic <br />development partnership between Olmsted Township and Olmsted Falls.) The city met <br />with the Olmsted Township trustees and the mayor of Olmsted Falls. They are <br />considering who will best serve the sewer needs of the JEDD, for both cost and quality. <br />They were very impressed that the city has already done preliminary planning in updating <br />the master plan. Our Olmsted Township prices per MCF are comparable to the Northeast <br />Ohio Sewer District. The Northeast Ohio Sewer District has implemented a 5% increase <br />every year for the next 3 to 5 years. If our rates stay comparable now, we will be the <br />least cost provider in the very near future. <br />Mayor Musial noted that the transfer legislation (Ordinance 2003-71) did not include <br />additional funds for the retention of the Assistant Superintendent's position at the WWTP <br />as the funds are already available in the plant's budget. <br />4 <br />
