Council Minutes of 3/18/2003 <br />process for persons or firms proposing to provide personal services to the city, and <br />declaring an emergency as twice amended. Councilman McKay moved for adoption. The <br />motion was seconded by Councilman Gateau and passed unanimously. Ordinance No. <br />2002-72 adopted. <br />Resolution No. 2002-165 imroduced by Mayor Musial was given its third reading. A <br />resolution authorizing the Mayor and Director of Finance to compensate Lisa Thomas, <br />former Director of Public Safety, for 99.5 hours of accumulated and unused <br />compensatory time, on a moral claim basis, and declaring an emergency. Councilman <br />Miller moved to table Resolution No. 2002-165. The motion was seconded by <br />Councilman Gateau and passed unanimously. Resolution No. 2002-165 tabled. <br />Resolution No. 2003-24 introduced by Councilman McKay on behalf of the Mayor was <br />given its third reading. A resolution authorizing the Service Director to advertise for bids <br />for the awazd of a contract to provide new pavement markings to various streets at various <br />locations in the city, as detailed in the specifications on file in the Engineering <br />Department, and authorizing the Mayor, following approval of the Board of Control, if <br />necessary, to contract for the same with the lowest and best bidder, and declaring an <br />emergency. Councilman McKay moved for adoption. The motion was seconded by <br />Councilman Nashaz and passed unanimously. Resolution No. 2003-24 as amended was <br />adopted. (The legislation was read in its original form; however, the legislation had been <br />amended at the Council meeting of March 4, 2003 to replace the word "Mayor" for <br />Service Director throughout the legislation. Council's vote was on the amended <br />legislation.) <br />Ordinance No. 2003-25 introduced by Council Member Kasler on behalf of Councilmen <br />Miller, Dailey, Nashaz, Gateau and herself was given its third reading. An ordinance <br />creating new Sections 139.12 and 141.08 of the Administrative Code, entitled, <br />respectively, "Additional Duties of Safety Director" and "Additional Duties of Service <br />Director," in order to require the Directors of Public Safety and Public Service to attend <br />all regular meetings of the City Council. Councilman Nashaz moved for adoption, and the <br />motion was seconded by Councilman Gateau. Roll call Nashaz, yes; Gateau, yes; Kasier, <br />yes, commenting that the Mayor has objected to the fact that there is no excused absence <br />provision in the ordinance. That issue was discussed in committee and deferred to the <br />Law Director who stated there is no necessity for such a clause. The Mayor objected to <br />the fact that the duties of the directors are being expanded when Council previously <br />reduced their salary. In her opinion, those are two very different issues. The salary range <br />change was a financial situation considered in light of poternial layoffs. She does not <br />believe it is expanding duties since attending meetings is part of the job. Roll call <br />continued: Limpert, no, commenting that, although he finds it most helpful when the <br />directors are at the meetings, he feels it is an administration function to have their people <br />at the meetings. Roll call continued: Dailey, yes; Miller, yes, commenting that it was his <br />understanding that the salary was reduced based on experience and equity. As far as the <br />issue as to whether it's an administrative decision, since the administration did not take it <br />upon themselves to provide such direction, the Council unfortunately had to take it upon <br />12 <br />
