Council Minutes of 3/1$/2003 <br />themselves. Roll call continued: McKay, yes. The motion passed with six yeas and one <br />nay. Ordinance No. 2003-25 adopted. <br />Resolution No. 2003-29 introduced by Councilman Miller on behalf of Council Member <br />Kesler and himself was given its third reading. A resolution authorizing and directing the <br />Mayor to study the feasibility of locating, and entering into a new water service <br />agreement with, a Lorain County public water system in order to procure water supply <br />services to the City of North Olmsted and its residents and property owners, and further <br />directing the Mayor to report to the Council on a regular basis regarding the status of his <br />efforts in this regard, and declaring an emergency. Councilman Miller moved for <br />adoption, and the motion was seconded by Councilwoman Kesler. Roll call: Miller, yes; <br />Kesler, yes; Limpert, yes, commenting that he had also done some work on this and <br />requested to be on this and was denied. Roll call continued: McKay, yes, commenting <br />that he thinks everybody understands that the water lines in the City of North Olmsted <br />belong to Cleveland. Before signing any contract, he would strongly urge that Cleveland <br />be contacted to find out if we will have to pay rent on these water lines. Most likely, if we <br />get water from another sowce, we will pay some type of maintenance or user's fee. Roll <br />call continued: Dailey, yes; Nashar, yes; Gareau, yes. The motion passed unanimously. <br />Resolution No. 2003-29 adopted. Mr. Miller noted with regard to Mr. McKay's <br />comments that those issues were initially looked at and are certainly part of this process, <br />and hopefully the Mayor will take that into consideration. As to Mr. Limpert's <br />comments, Mr. Pangrac has been coming to Council meetings for several years about this <br />issue and nothing had been done. The issue was discussed in committee; therefore, he <br />thought it was best that those who have shown some interest in getting it done put their <br />name on the legislation. Mayor Musial said he thought that the current contract with the <br />City of Cleveland requires afive-year notice to cancel. Law Director Dubelko said that <br />was true. The Law Department has not had a full opportunity to study the contract. <br />However, it is for a fixed number of years, with automatic renewals from year to year, <br />and with the provision that, if you want to terminate it, you have to give five year's <br />notice. <br />Resolution No. 2003-30 introduced by Councilman Miller on behalf of the Mayor was <br />given its third reading. A resolution creating a new Citizens' Committee for the purpose <br />of gathering and presenting to City Council projects for consideration for the city's <br />Community Development Block Grant (CDBG) applications for fiscal years 2004 <br />through 200b as amended. Councilman Miller moved for adoption. The motion was <br />seconded by Councilman Gareau and passed unanimously. Resolution No. 2003-30 <br />adopted. <br />Resolution No. 2003-34 introduced by Councilman Miller was given its third reading. A <br />resolution supporting the Cuyahoga County Mayors and Managers Association's study of <br />the feasibility of forming a regional water department similar to the Northeast Ohio <br />Sewer District, and declaring an emergency. Councilman Miller moved far adoption, and <br />the motion was seconded by Councilman Gareau. Roll call: Miller, yes; Gareau; yes; <br />Dailey, yes; McKay, yes; Kesler, yes; Limpert, yes, with comment that his remarks on <br />the earlier ordinance also hold true with this one.
