Council Minutes of 3/18/2003 <br />also an increase in new real property tax revenue. Unfortunately, that will not be paid <br />unti12004. <br />Law Director Dubelko: 1) On March 5, he attended a meeting with the Mayor, the <br />Finance Director, the City Engineer and Fairview Park officials regarding the service <br />agreement for sanitary sewer services with the Fairview Park satellite district. After that <br />meeting afollow-up memo was sent to the city's consulting engineer to ensure that any <br />EPA required or recommended changes in the service agreement be presented to the <br />administration for negotiation with Fairview Park. It may be that Council will be seeing <br />some legislation coming down the line from the consulting engineer for doing additional <br />environmental services for the city in connection with the Fairview Park service <br />agreement andJor the Olmsted Township service agreement. <br />2) On Mazch 6, he attended a meeting with Olmsted Township and county officials and <br />again with the Mayor, Finance Director and others regarding the Township service <br />agreement including the expansion of the sewer district in the Township for the 7EDD <br />project. <br />3) On Mazch 7, he prepared and distributed memos to the administration and to Council <br />supplementing the legal opinion previously drafted regarding the legality of comp time <br />for non-bargaining unit officials and employees who are exempt from the overtime <br />compensation regulations of the Fair Labor Standards Act. <br />4) On Mazch 8, he notified the Department of Personnel of a claim that had been made <br />against the city by two minors who alleged through their attorney that they had been <br />assaulted by several North Olmsted police officers at the mall. These types of claims are <br />received from time to time and are typically turned over to the Personnel Department to <br />contact the city's risk manager. <br />5) On March Z 0, he provided legal advice to the Finance Director in the form of a <br />memorandum discussing the duties and responsibilities of city auditors. This is one of <br />the functions of the Finance Director's office. In the City Charter, the Finance Duector <br />has the duties which are imposed by state law upon city auditors. <br />6) On March 11, he attended a Board of Control meeting to discuss fee proposals <br />received from engineering firms for design engineering for road culverts on Bradley <br />Road and Windsor Drive. Because of possible funding shortages, the boazd took no <br />action at that time pending additional information from the Service Department. The <br />Board of Control met again today on that same issue and once again took no action <br />because of questions that remain regazding this project's urgency at this time. <br />7) On March i 1, he provided the State Auditor's office with a copy of his legal opinion <br />regarding use of comp time by city officials. <br />8) On March 12, he provided the Civil Service Commission with legal opinion 2003-4, <br />which discusses the subjects of eligibility lists and contracting for testing services. <br />9) bast week, he attended the wake for Mary Slama, former administrative assistant to <br />Mayor Swietyniowski. He got to know Mary when she was serving as Mayor <br />Swietyniowski's assistant and they worked on numerous projects together. She was an <br />extremely fine human being. As the Administrative Assistant, she did a lot of the things <br />that are now part of the duties of the Personnel Director. <br />10) On March 13, he attended a meeting at the Cuyahoga County Law Director's <br />Association. The topic for discussion was historic tax credit transactions. He thought it <br />2 <br />
