Council Minutes of 12/7/2004 <br />President O'Grady announced the following legislation would be considered for passage <br />under suspension of the rules: first reading, Resolutions 2004-132 and 2004-193. <br />President O'Grady announced a special Council meeting would be held at 7 p.m. on <br />Wednesday, December 8, in the Mayor's conference room regarding the RTA operating <br />agreement. <br />REPORTS <br />Mayor Musial: 1) He attended the Council committee meeting regarding the Master <br />Plan, and it was very well presented. <br />2) He attended the Community Council president's dinner and gave the oath of office to <br />the new officers of the North Olmsted Community Council. <br />3) The VFW Police and Fireman of the Year dinner was recently held to honor Fireman <br />Weisbarth and Policeman Calvitti. <br />4) The tree lighting ceremony was held on Monday, December 6. It was a pleasant <br />evening for all as Santa, Mrs. Claus and their friendly elf were there as well as carolers <br />from Chestnut School and the Pep Band from the high school. <br />5) The Springvale Task Force report was received and distributed to Council. He hasn't <br />had a chance to review it, but he did believe there was an error in that the report noted <br />meetings were held with the previous Law Director. To his knowledge that did not <br />occur. <br />,~ 6) Extensive discussions and meetings have been held regarding the situation involving <br />NOMBL and RTA. Some of the areas involve legal aspects, and he will refer any further <br />reporting to the Law Director. <br />7) A revised timeline and target dates have been prepared for the Fire Station No. 2 <br />replacement project. It is being reviewed, and a recommendation will be made to <br />Council in the next few weeks. <br />8) The last of three passes for leaf collection is being completed. Last year's collection <br />was approximately 17,000 cubic yards, and this year several thousand more cubic yards <br />have been collected. Once the contractor has completed the final pass, city employees <br />will make a list of areas where leaves remain, and the list will be given to the contractor. <br />When that list has been completed, the program will be complete. <br />Law Director Dubelko: 1) Litigation update: <br />• November 26, received notice from the Court of Common Pleas that a case <br />management conference in the Ganley court action has been set for January 14, 2005. <br />• November 30, the city's appeal in the Dana Joyce case was settled and dismissed <br />based upon the settlement that was authorized by Council. <br />• November 30, a case management conference was held in the Nancy Kovacik case. <br />The case has been referred to court mediation, and the court has set diapositive <br />motion deadlines, final pre-trial and a jury trial date in the middle of 2005. <br />• December 3, notification was received from SERB that the unfair labor practice that <br />the city had filed against the fire fighters in the midst of the negotiation period had <br />been dismissed. The city had alleged that the fire fighters had committed an unfair <br />labor practice by submitting the subject of minimum staffing issues to the fact finder. <br />2 <br /> <br />
