Council Minutes of 10/19/2004 <br />number of parcels of land that would satisfy the Fire Department's needs. This City <br />_~, Council has exacted a pledge from the Mayor that, when it comes time if the bond issue <br />is passed, that the negotiation for land acquisition will be done by the Law Dept. and the <br />Mayor's office will not be involved in it. Any action taken to acquire land will be <br />approved by City Council and it won't be land that is picked by the Mayor or favors the <br />Mayor or any of his clients. He does not want to get involved in any more lawsuits with <br />the Mayor at this point in time. Councilman Miller's issue should be addressed, but <br />however it is addressed is not going to impact on what this city can do if the bond issue is <br />passed in going forward to acquire land for the new fire station. Councilman Miller <br />replied he thinks the appearance of impropriety needs to either be confirmed or denied <br />and that is the necessity for those records. Law Director Dubelko responded that he <br />thinks the Mayor believes the memo addressed the two requests. If it doesn't and if <br />Councilman Miller renews his request, he will counsel the Mayor and ask hirn to respond. <br />As he has said before, City Council, if anything, is entitled to more records than even the <br />public is to do its job. <br />Jim Burns, 3978 Dover Center, said the big problem is that under the ORC, the finance <br />laws were written at the turn of the 20th century. Any money spent before the project <br />funds are borrowed cannot be covered by the borrowed money. Council did have some <br />solid numbers and some good estimates on what it was going to cost without spending <br />hundreds of thousands of dollars to do engineering and cost estimates to put this on the <br />ballot. <br />Assistant Fire Chief Robertson: Recognized Meredyth McKenzie, Sun Herald reporter <br />who did a fabulous job of explaining the fire station levy issue. There were pictures <br />included with the article, and she had all the facts. <br />LEGISLATION <br />Ordinance No. 2003-182 introduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor, upon the review and approval of the Board of Control, <br />to enter into a sole source and direct purchase agreement with Harrington Electric <br />Company for the acquisition of a 750 KVA Mineral Filled Transformer for the <br />Wastewater Treatment Plant, without public bidding, and declaring an emergency. <br />Councilman Nashar moved to table. The motion was seconded by Councilman Gareau <br />and passed unanimously. Ordinance No. 2003-182 tabled. <br />Ordinance No. 2004-156 introduced by Councilman Gareau was given its second <br />reading. An ordinance amending Section 505.01 of Chapter 505 of the General Offenses <br />Code entitled "Dogs and Other Animals Running at Large," and also amending Section <br />947.01 of Chapter 947 of the Streets, Utilities and Public Service Code entitled "Rules <br />and Regulations" in order to permit dogs to be walked under leash on city park and <br />recreation property. Councilman Gareau moved to table. The motion was seconded by <br />Councilman Dailey.
