Council Minutes of 10/19/2004 <br />REPORTS <br />~~.:~,: Law Director Dubelko reported for Mayor Musial: 1) At a recent Cultural Activities <br />Commission, the Mayor administered the oath of office to new members Barbara Brown <br />and Gerald Yustick. <br />2) The Mayor recently coordinated and provided three tours of City Hall, the Service <br />Garage and the Police Dept. for students of Butternut Ridge Elementary School. <br />3) A proclamation was made on the Mayor's behalf by Councilman Limpert to new Eagle <br />Scout Paul Moizuk, member of Boy Scout Troop 332, and a resident of Ward I, at his <br />Eagle Court of Honor on October $. <br />4) On October 13, the Mayor attended the annual Seniorfest at Springvale which was <br />hosted by 86 SITES students representing the Class of 2005. As always, the seniors <br />enjoyed the event which included live music, a dance contest, a TV trivia contest, <br />dancing with the high school SITES students and refreshments. <br />5) This Thursday, October 21, at twelve noon and 5 p.m., public hearings will be held as <br />to the matter of potentially discontinuing NOMBL bus route 53. The Mayor intends on <br />making initial remazks at the noon meeting as he has already committed to present a State <br />of the City address to the North Olmsted Chamber of Commerce at 12:30 p.m. on that <br />same date. He will be present for the entire hearing at 5 p.m. He urges any Council <br />member or other interested individuals to attend the hearing. <br />Law Director Dubelko: 1) Litigation update: <br />^ On October 6, he received notice that SERB had dismissed the unfair labor practice <br />charge that the FOP had filed against the city alleging that the city did not bargain in <br />good faith because it had allegedly not disclosed that elected officials whose salaries <br />were set by law in the year 2000 would be getting pay raises in 2004. SERB found <br />no probable cause to proceed further on that complaint. <br />^ It has been his habit to report unfair labor charges that are filed by the city or by the <br />unions and disposition of them. He believes that falls under the heading of litigation, <br />and believes it's something that the City Council should always aware of and brought <br />up to date on. It is in no way to disparage union members or to comment in any <br />fashion upon how they do their jobs as city employees, whether they're service <br />workers, police officers, fire fighters or WWTP workers. It's the nature of <br />labor/management relations that sometimes both sides don't see eye-to-eye, and <br />fortunately we have a lot of good processes in place that enable us to resolve our <br />differences in an amicable fashion. The filing of unfair labor practice charges is one <br />of the ways that we do this when one side feels that the other side is engaged in an <br />activity that violates some of the basic SERB laws. They have that absolute right to <br />file it, and the other side has the absolute right to defend against it. <br />^ On October 12, the city filed an unfair labor practice charge against the IAFF Local <br />1267 regarding the union's invitation to Council members to attend a union meeting <br />to discus, among other things, "pending grievances and our still unresolved collective <br />bargaining agreement." He felt, on behalf of the administration, that it was important <br />to file that unfair labor practice charge and trusts that it will be resolved through the <br />legal process. <br />2 <br /> <br />
