Council Minutes of 10/19/2004 <br />,~ , <br />^ October 14, he met with a planning expert and the city's insurance defense counsel to <br />discuss the pending Ganley litigation. Insurance defense counsel has taken a Leave to <br />Plead the city's answer, which now will be due on or about November 25. <br />^ On October 14, he received notice from attorney Gary Johnson that two of the fire <br />fighter grievances relating to management rights issues have been set for arbitration <br />hearings on November 8 and November 12. The same comments made regarding <br />unfair labor practices pertains to grievances. This is our process. If the union or any <br />of the bargaining employees are not happy with the city's administration, under the <br />labor contracts they have the absolute right to file a grievance. All the grievances <br />proceed through a Step 1, Step 2, Step 3 process internally. If there still is not a <br />resolution that is satisfactory to both sides, then an appeal can be taken to arbitration. <br />These two particular grievances which involve things like call back and staffing have <br />been set for arbitration, and they will be arbitrated. <br />^ On October 15, the city's insurance defense counsel filed an answer on behalf of the <br />city and its named defendants in the Nancy Kovacic case. <br />^ On October 19, an arbitration hearing regarding the correction officer grievance has <br />been set for November 30 before arbitrator David Pincus. <br />2) Collective bargaining update: <br />^ Negotiations with all seven of the city's bargaining units have been completed, but <br />four contracts are outstanding. Three of the contracts have been approved and <br />executed. A fourth one (Service unit) has been approved and is on its way to <br />execution. Two contracts have been approved by the union memberships but have <br />not yet been submitted to or approved by City Council because some relatively minor <br />language differences have to be worked out. The ClericallTechnical unit has recently <br />approved the contract and hopefully will be presented to Council at the next meeting. <br />3) October 6, he provided the Mayor with legal advice regarding appointing city <br />representatives to the RITA Board of Trustees. <br />4) October 7, he provided an employer position statement to the employee health care <br />committee regarding the start date for the six month period the committee has to reform <br />the city's health care plan. <br />5) October 11, he attended a fire dispatch center meeting at City Hall. <br />6) October 12, he attended a directors' meeting at City Hall. <br />7) October 12, he provided legal advice to the Recreation Commissioner regarding <br />contract issues relating to the purchase of playground equipment for the N. O. Park. <br />8) October 13, he attended a meeting with the Director of Human Resources, Director of <br />Planning and representatives of New Avenues regarding the city's facility on Butternut <br />Ridge Road, which has served since 1989 as an early intervention center for disabled <br />kids. <br />9) October 13, he attended a properly noticed meeting of the city records commission. <br />The commission approved retention schedules and aone-time records destruction <br />schedule submitted by the Finance Dept. <br />10) October 14, he provided legal advice to the Fire Chief regarding the subject of trading <br />shifts in the Fire Dept. <br />11) October 14 through 17, he reviewed for legal sufficiency the proposed contract <br />between the city and MUNIS for implementation of the city's new financial accounting <br />system. <br />3 <br />_.. <br />r~~, _ _;. ~.., <br />„~ - <br />I <br />
