Council Minutes of 9/21/2004 <br />~ spots for larger buildings and the city will gain nothing as a result. We will not gain any <br />:;~,, green space. The motion passed with five yes votes and two no votes. <br />Ordinance No. 2004-66 adopted. <br />Resolution No. 2004-129 introduced by Mayor Musial was given is third reading. A <br />resolution authorizing the Mayor of the City of North Olmsted to enter into a renewal <br />agreement with the Department of the Navy for the lease of two (2) EA.AN/PVS-5 night <br />vision goggles to be used by the North Olmsted Police Department, and declaring an <br />emergency. Councilman Gazeau moved for adoption. The motion was seconded by <br />Councilman Nashar and passed unanimously. Resolution No. 2004-129 adopted. <br />Ordinance No. 2004-130 introduced by Councilman Dailey on behalf of himself, <br />Councilman Miller and Councilwoman Kasler was given its third reading. An ordinance <br />creating new Section 505.081 and amending Section 505.08 of Chapter 505 of the <br />General Offenses Code entitled "Animals and Fowl," in order to require that dog owners <br />carry materials or implements for collecting feces while walking their dogs, and further to <br />more clearly establish that allowing animals to defecate on the properties of others <br />creates a nuisance condition proscribed by Section 505.08. Councilman Miller moved for <br />adoption. The motion was seconded by Councilman Dailey and passed unanimously. <br />Ordinance No. 2004-130 adopted. <br />Ordinance No. 2004-133 introduced by Mayor Musial was given its third reading. An <br />ordinance authorizing the Mayor to errter into cone-year personal services agreement <br />with the law firm of Rademaker, Many, McClelland & Greve to provide professional and <br />specialized legal services, and declaring an emergency, as amended. Councilman Gareau <br />moved for adoption. The motion was seconded by Councilman Miller and passed <br />unanimously. Ordinance No. 2004-133 adopted. <br />Ordinance No. 2004-119 introduced by Mayor Musial was given its second reading. An <br />ordinance amending Sections 1345.01 and 1345.02 of the Building Code to exclude <br />Landscaping features from permit and fencing requirements in Section 1345.01 and <br />1345.02 and declaring an emergency, as amended. <br />Ordinance No. 2004-137 introduced by Councilwoman Kasler on behalf of Mayor Musial <br />was given its second reading. An ordinance to make and transfer appropriations for <br />current expenses and other expenditures for the City of North Olmsted for the year <br />ending December 31, 2004 as amended. Councilwoman Kasler moved for suspension of <br />the rules requiring three readings and noted the legislation had been heard in committee. <br />Law Director Dubelko called for a point of order and asked that the legislation be <br />amended first. Councilwoman Kasler withdrew her motion to suspend the rules requiring <br />three readings. Councilwoman Kasler made a motion to amend Ordinance 2004-137 <br />consistent with the recommendations made by the committee. The motion was seconded <br />by Councilman Gareau and passed unanimously. Ordinance No. 2004-137 amended. <br />Councilwoman Kasler made a motion to suspend the rule requiring three readings and <br />noted the legislation had been heard in committee.
