Council Minutes of 9!7/2004 <br />clearly establish that allowing animals to defecate on the properties of others creates a <br />nuisance condition proscribed by Section 505.08 <br />Ordinance No. 2004133 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Mayor to enter into cone-year personal services agreement <br />with the law firm of Rademaker, Malty, McClelland & Greve to provide professional and <br />specialized legal services, and declaring an emergency, as amended. <br />Resolution No. 2004-136 was introduced and placed on first reading by Councilman <br />Limpert on behalf of Mayor Musial. Anew and revised resolution approving of and <br />authorizing the Mayor to enter into a collective bargaining agreemern with the American <br />Federation of State, County and Municipal Employees ("AFSCME"), Ohio Council 8, <br />Local 2681 for the city's Service Unit employees, for the period July 1, 2004 through <br />June 30, 2007 and declaring an emergency. Councilman Limpert moved for suspension <br />of the rules requiring three readings and committee review. The motion was seconded by <br />Councilman Dailey and gassed unanimously. Dennis Lambert, 25057 Carey Lane, said <br />he thought it would be appropriate to note that this issue had been discussed in committee <br />previously. Councilman Limpert moved for adoption. The motion was seconded by <br />Councilman Dailey and passed unanimously. Resolution No. 2004-136 adopted. <br />Ordinance No. 2004-137 was introduced and placed on first reading by Councilwoman <br />Kasler on behalf of Mayor Musial. An ordinance to make and transfer appropriations for <br />current expenses and other expenditures for the City of North Olmsted far the year <br />ending December 31, 2004. <br />Ordinance No. 2004138 was introduced and placed on first reading by Councilman <br />Nashar on behalf of Mayor Musial. An ordinance enacted by the City of North Olmsted, <br />Cuyahoga County, Ohio, hereinafter referred to as the Local Public Agency (LPA), in the <br />matter of the stated described project (Improvement of Great Northern Boulevard from <br />Butternut Ridge Road to Country Club Boulevard), and declaring an emergency. <br />Ordinance No. 2004-139 was introduced and placed on first reading by Councilwoman <br />Kasler on behalf of Mayor Musial. An ordinance amending range of compensation rates <br />for existing positions in the Department of Human Resources for the years 2004 and <br />2045; and otherwise re-stating the compensation rate ranges for various administrative <br />and legislative personnel for the years 2004 and 2005, and declaring an emergency. <br />Resolution No. 2004-140 was introduced and placed on first reading by Councilman <br />Nashar on behalf of Mayor Musial. A resolution authorizing the Mayor to submit and <br />seek financial assistance from the State Issue 2 Infrastructure Bond Program for funding <br />of various municipal capital infrastructure improvements projects, and declaring an <br />emergency. <br />10 <br />
