Council Minutes of 8/17/2004 <br />2) With regards to Butternut Ridge Road repairs in front of the library, a schedule from <br />~~ the contractor is not expected until August 24 because he has other projects that <br />apparently are taking precedence at this point in time. The good news is that to mill <br />Butternut Ridge Road from Dover Center to Lorain Road will only take about a day. The <br />paving also will only take about a day. So the project is a two-day process. <br />3) During the past few weeks, he has had meetings with school superintendent Dr. Stank; <br />Marjorie Snyder, the current president of the Chamber of Commerce; Mike McIntosh, the <br />general manager of Great Northern Mall. Also, he met with County Engineer Bob <br />Klaiber for discussions regarding the Crocker/Steams Road construction. It appears that <br />we may have to negotiate a new agreement because of some changes. He has consulted <br />with the Law Director and it will probably be brought to Council the first part of <br />September. <br />Councilman Nashar expressed concern about the timing of the repaving of Butternut <br />Ridge Road because schools will be opening very shortly. Mayor Musial said he and Mr. <br />Driscoll were aware of that and the city has attempted to expedite the project. <br />Councilman Nashar asked if the county still planned to keep to the same construction <br />timetable for Crocker/Steams. Mayor Musial said the time schedule has not changed, but <br />there are some other items that are coming up which are favorable. <br />Law Director Dubelko: 1) Litigation update: There have been no changes in the civil <br />litigation cases involving the city. A worker's compensation appeal has been filed by <br />Mr. Sermak, (Sermak vs. the City of North Olmsted, Cuyahoga County Common Pleas <br />case No. CV04537245, Judge Judith Kilbane Koch). The case has been assigned to <br />defense by worker's comp counsel, and the Law Dept. will monitor it in-house. <br />2) There are four real property maintenance cases pending in Rocky River Municipal <br />Court: City of North Olmsted vs. Murphy; City of North Olmsted vs. Chereson; City of <br />North Olmsted vs. BP Exploration and Oil Company; City of North Olmsted vs. Terpel. <br />All those cases are being handled by Assistant Law Director O'Malley. The case <br />involving Samir Khouri regarding the refuse containers at the apartment building on <br />Clague Road has been resolved. The city filed five complaints, and there was a finding <br />of guilty and a fine in all five. To the best of his knowledge, we have compliance. There <br />are refuse containers available which are satisfactory to the Service Director. <br />3) A negotiation session is scheduled with the AFSCME ClericaUTechnical unit on <br />August 23. <br />4) At the last Council meeting, he had indicated to Council that he would be issuing a <br />memo on recommendations for revisions/reforms of the city's ethics code. On further <br />consideration, he feels that, since we have a local Ethics Commission, it might be better <br />to bring that matter to the local Ethics Commission's attention and have recommendations <br />coming out of that body rather than directly out of the Law Department. He has <br />contacted the chairperson of the Ethics Commission, Finance Director Copfer, and <br />requested that a meeting be scheduled, hopefully in September, to look at some of the <br />issues on whether or not we should continue to have a local Ethics Commission or <br />whether we should have a local ethics code. <br />5) On August 5, 2004, he attended an ADA panel discussion at the new library.
