Council Minutes of 8/17/2004 <br />businesses to the ADA and what compliance with the act entailed for local businesses. <br />Much credit for this panel discussion should go to both Planning Director Kim Wenger <br />and Human Resources Director Don Copeland who devoted a lot of effort to setting it up. <br />This is one good example of how the City of North Olmsted and the business community <br />can work together on an effort to make the city a better place in which to live. <br />6) In late July, the city's Law Department experienced its second crash of their server <br />hazd drive. The city's new computer consultant, Denny Barto, did a very good job of <br />determining why there have been two server crashes in the past yeaz and was able to fix <br />the problem. He was also able to recover data from the hazd drive. Kudos to the new <br />consultant. <br />7) On August 12, he responded to a public records request for information related to the <br />fire fighters' entrance level examination for Civil Service. He has provided legal advice <br />to the Civil Service Commission regarding that public records request. <br />8) On August 12, the Cuyahoga County Court of Appeals decided the case of City of <br />North Olmsted vs. Himes. This was an appeal taken by a defendant from his conviction <br />for reckless operation in Rocky River Municipal Court. The defendant claimed that the <br />trial court erred by failing to dismiss the charge against him which was reinstituted <br />following a declazation of mistrial by the trial court judge in the first trial on the same <br />chazge. The city defended the trial court's ruling in the Court of Appeals. However, the <br />Court of Appeals concluded that the circumstances under which the mistrial was <br />announced in the first trial precluded a retrial of this defendant. Accordingly, the court <br />reversed the trial court's decision. After reviewing the substance of the Court of Appeals <br />decision as well as considering the fact that the conviction was for a misdemeanor <br />offense and that it is improbable that the Supreme Court would elect to take to this case <br />in, he does not believe that the decision should be further appealed. <br />9) He attended a Boazd of Control meeting on August 10 and directors' meetings on <br />August 10 and 17. <br />10) On August 16, he met with the Service Director, Finance Director and the NOMBL <br />Manager to discuss the renewal of the RTA operating agreemenrt. That group is <br />scheduled to meet with RTA officials on August 30 to formally begin the process of <br />negotiating a renewal of the agreement. The current agreement was for the five-year <br />period 1999 through December 31, 2004. The current relationship between the city and <br />RTA is excellent, in large part due to the leadership of NOMBL Manager Tom Terbrack <br />and the city's cooperative efforts with the Park-n-Ride. There is every reason to believe <br />that the negotiations for renewal of the operating agreement will be very productive, and <br />he thinks RTA will make every effort to complete those negotiations and get a renewal <br />agreement back to Council in time so Council can adequately review it and enact on the <br />legislation to approve the renewal agreement. <br />Finance Director Copfer: 1) Under a new Ohio Administrative Code Section 742-7-14, <br />the Ohio Police and Fire Pension Funds aze requiring the city to pass a new resolution to <br />put on file with them for employers reporting their member contributions on a tax- <br />deferred basis. This has been done since the mid-1980's. They sent a model resolution <br />which was utilized by the Law Dept. in drafting ordinances 2004-134 and 2005-135. <br />This doesn't change anything that we had been doing. It just reaffirms that we aze doing <br />it on atax-deferred basis for the employee's share. <br />3 <br /> <br />
