Council Minutes of 8/17/2004 <br />feel the necessity to appeal Mr. Conway's decision and go before the Board of <br />Building Code Appeals in order to be permitted to put in a pond without a fence. One <br />issue of concern in the ordinance was there doesn't seem to be any clarification as to <br />how big a pond could be before a fence would be required. Because it was not clear <br />in that regard, the committee believed it was best to hold it in committee and <br />unanimously did so with the suggestion that the Law and Building Departments <br />should come together to establish criteria that is more definite as to the size of the <br />pond that could be permitted before a fence would be required. Ordinance 2004-119 <br />was held in committee. <br />• Ordinance 2004-66 was discussed, but the report will be made when the legislation is <br />on the agenda for third reading. <br />LEGISLATION <br />Ordinance No. 2004-106 introduced by Councilwoman Kasler was given its third <br />reading. An ordinance creating new Section 109.07 of Chapter 109 of the Administrative <br />Code, entitled "Public Meetings," in order to clarify the clerical positions responsible for <br />open meetings and public records functions arising out of meetings and other <br />governmental actions of the various boards and commissions of the city, and declaring an <br />emergency. Councilman Gareau moved for adoption. The motion was seconded by <br />Councilman Nashar and passed unanimously. Ordinance No. 2004-106 adopted. <br />Resolution No. 2004-108 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the payment of seven thousand four hundred seventy-one <br />($7,471.00) dollars to Hughie's Audio Visual for the installation of special lighting for <br />the May 21, 2004 ice show. Councilman Dailey moved for adoption. The motion was <br />seconded by Councilman Limpert and passed unanimously. Resolution No. 2004-108 <br />adopted. <br />Resolution No. 2004-109 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the payment of one thousand forty-nine dollars ($1,049.00) to Joe <br />D's Printing for programs for the May 21, 2004 ice show. Councilman Nashar moved for <br />adoption. The motion was seconded by Councilman Dailey and passed unanimously. <br />Resolution No. 2004-109 adopted. <br />Resolution No. 2004-110 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the payment of five thousand one hundred ninety dollars <br />($5,190.00) to Jeff Marshall for costumes for the May 21, 2004 ice show. Councilman <br />Dailey moved for adoption. The motion was seconded by Councilman Nashar and <br />passed unanimously. Resolution No. 2004-110 adopted. <br />Ordinance No. 2004-43 introduced by Mayor Musial was given its second reading.
