Council Minutes of 6/1/2004 <br />buildings and further authorizing the Mayor, after Board of Control approval, to execute <br />a contract with the lowest and best bidder. <br />Ordinance No. 2004-102 was introduced and placed on first reading by Councilman <br />Limpert on behalf of himself and Councilman Gareau. An ordinance amending Section <br />One of Ordinance No. 2003-162, which established a new "Building and Land <br />Acquisition and Improvement Fund" of the City of North Olmsted, so as to provide for <br />said new fund to be a capital improvement fund, rather than a special revenue fund, and <br />declaring an emergency. Councilman Limpert moved for suspension of the rules <br />requiring three readings and committee review and noted that this is just an accoutrting <br />function and the basic concepts were discussed previously when Ordinance 2003-162 <br />was passed. The motion was seconded by Councilman Gareau and passed unanimously. <br />Paul Barker, 23629 Carriage Lane, asked for clarification if this was the money from the <br />sale of the library. Finance Director Copfer answered yes and explained, when a fund is <br />created, it must have a designation as a certain type of fund. When the Building and <br />Land Acquisition and Improvement Fund was created, it was incorrectly designated as a <br />special revenue fund. It is a capital improvement fund type. So, this needs to be fixed, <br />but it does not change any of the purposes. Councilman Gareau moved for adoption. <br />The motion was seconded by Councilman Limpert and passed unanimously. Ordinance <br />No. 2004-102 adopted. <br />Ordinance No. 2004-103 was irnroduced and placed on first reading by Councilman <br />Gareau. An ordinance amending Section 149.02 of Chapter 149 of the Administrative <br />Code of the City of North Olmsted, entitled "Planning Commission" so as to expand <br />notification of residents and property owners for review of development plans which also <br />include rezoning proposals. <br />Ordinance No. 2004-144 was introduced and placed on first reading by Councilman <br />Gareau. An ordinance amending Section One of Ordinance No. 2004-18, which provided <br />for the Director of Law to retain the law firm of Johnson, Angela & Colaluca, LLC, as <br />outside counsel to assist the city in labor negotiations, so as to authorize an additional <br />expenditure of funds pursuant to the said contract entered into between the city and said <br />law firm, and declaring an emergency <br />Councilman Gareau moved that Council reconsider Ordinance No. 2004-41 which was <br />vetoed by the Mayor. The motion was seconded by Councilman Miller. Roll call: <br />Gareau, yes; Miller, yes; Nashar, yes; Limpert, no with comment he does not feel Council <br />has done its homework on looking on what is the norm for these sort of positions. He <br />does not feel it is proper to be messing with the morale of key individuals for such small <br />amounts. Roll call continued: Dailey, yes with comment that he did read the memo from <br />the Mayor regarding his veto. He did give it some consideration. But after finding out <br />that the directors came in for emergency purposes a total of three times between the two <br />of them in all of 2003, it took away one of the arguments that the directors should have <br />these cars in the event of emergencies. Roll call continued: McKay, no; Kasler, yes. <br />The motion to reconsider passed with five yeas and two nays.
