Council Minutes of 5/4/2004 <br />;~ Resolution No. 2004-74 introduced by Councilman Nashar and Councilman Gareau was <br />=~a„~J given its second reading. A resolution urging the Governor and the Ohio General <br />Assembly to reconsider and amend House Bill 12, the new state carrying weapons law, so <br />as to authorize municipal corporations to prohibit state licensees from carrying weapons <br />in municipal parks and upon parking lots and other grounds and premises surrounding <br />municipally-owned buildings; further to permit municipal corporations, as employers to <br />prohibit their employees, who are not state-certified police officers, from carrying <br />weapons during and in the course of their employment as municipal employees, and <br />declaring an emergency. Councilman Nashar moved for suspension of the rules requiring <br />three readings and noted the legislation had been reviewed by committee. The motion <br />was seconded by Councilman Gareau and passed unanimously. Law Director Dubelko <br />said he wanted to make it clear that from the Law Department's perspective, Councilman <br />Gareau hit it right on the head. This is not about whether or not you favor people having <br />the right to cant' weapons, it is whether you are in favor of home rule for cities to <br />determine how they govern conduct on their property and whether or not they can control <br />the activities of their employees. Councilman Nashar moved for adoption, and the <br />motion was seconded by Councilman Gareau. Roll call: Nashar, yes; Gareau, yes, <br />commenting that he would like to incorporate his previous comments into his vote. Roll <br />call continued: Kasler, yes; Dailey, yes; Limpert, no, commenting though we prohibit the <br />hitting of golf balls in the park, we do not prohibit concealing them in ow pocket. Roll <br />call continued: McKay, yes; Miller, yes. The motion passed with six yeas and one no. <br />Resolution No. 2004-74 adopted. <br />Ordinance No. 2004-79 introduced by Councilman Gareau was given its second reading. <br />An ordinance amending Sections 109.02, 109.03, 109.04, and 109.06, of Chapter 109 of <br />the Administrative Code, entitled "Public Meetings," in order to provide for notice of <br />Charter Review Commission meetings and clarify language in various sections of <br />Chapter 109 and declaring an emergency. <br />Resolution No. 2004-82 was introduced and placed on first reading by Councilman <br />Limpert on behalf of Mayor Musial. A resolution dispensing with the RFP process <br />required by Sections 111.03 et seq. of the Administrative Code, authorizing the Mayor to <br />enter into a renewal agreement with Jeffrey A. Grusenmeyer & Associates, Inc., for an <br />additional one year term, to serve as plans examiner for the North Olmsted Building <br />Department, and declaring an emergency. <br />Resolution No. 2004-84 was introduced and placed on first reading by Councilman <br />Dailey on behalf of Mayor Musial. A resolution authorizing the Mayor to enter into an <br />agreement with L & K Heating & Cooling Inc. to perform annual maintenance of heating <br />and cooling equipment at various city facilities and declaring an emergency. <br />Ordinance No. 2004-85 was introduced and placed on first reading by Councilman <br />Dailey on behalf of Mayor Musial. An ordinance amending Ordinance No. 2002-14 to <br />clarify and define eligibility requirements for the "We Care" program and to otherwise <br />restate program fees for the use of the Parks and Recreation facilities. <br />14 <br />
