Council Minutes of 4/20/2004 <br />Law Director Dubelko: 1) The Law Department received notice on April 7 that there had <br />been a voluntary dismissal of Michael Plute vs. the City of North Olmsted. This was an <br />employment-related case being defended by the city's insurance defense counsel. <br />2) April 12, he met with the Mayor and the Safety Director regazding real property <br />maintenance in the city. That meeting resulted in a legislative request from the Mayor, <br />which is Ordinance 2004-80. <br />3) The labor contract with NOMBL employees was executed on April 12. <br />4) On April 13, Assistant Law Director O'Malley filed atwo-count complairn in Rocky <br />River Municipal Court against the owner of the multi-family premises at 3784 Claque <br />Road for violations of the city's refuse code. That matter has been set for initial <br />appearance hearing on May 4. <br />5) April 15, he issued a memo to all directors and division heads as a reminder of Council <br />Rule 40 which requires that all exhibits be attached to legislative requests, particulazly <br />contracts when the administration is seeking Council authorization. <br />6) April 15, he attended a Fair Housing Review Boazd meeting. The board voted at that <br />meeting to recommend to the Mayor that Don Copeland be appointed as the first <br />administrator of the city's Fair Housing Board. <br />7) On April 16, city Prosecutor Dan Ryan filed an appellee brief in the Court of Appeals <br />in the case of City of North Olmsted vs. Robert I~iimes. This case involves a double <br />jeopazdy question. <br />8) April 16, he conducted law clerk interviews. <br />9) April 19, Assistant Law Director O'Malley attended a sentencing in another real <br />property maintenance case in Rocky River Municipal Court. The owner of property at <br />4107 Columbia Road was sentenced on four counts of violating the city's real property <br />maintenance code and fined a total of $300 plus costs. The city is continuing to work on <br />getting that property up to code. <br />10) April 19, he issued legal opinion 2004-2 in response to a request from Councilman <br />Limpert regazding the line between Council's legislative authority and the <br />administration's administrative authority regarding operations in the city's Service <br />Department. <br />11) Attended various meetings including a mediation session with fire fighters, afact- <br />finding hearing with fire fighters, a management meeting in preparation for collective <br />bargaining with Service and Clerical-Technical employees, a Board of Control meeting <br />and a directors' meeting. <br />Finance Director Copfer: 1) Since she could not attend the library opening on Sunday, <br />she and her son visited on Monday evening. It was a hopping place! Everyone was <br />smiling and happy. The younger children were very happy with their story room, and the <br />teenagers were amazed at the technology. It was exciting to see. Thank you to the <br />residents for supporting the new library. <br />2) The renewal bond anticipation notes were sold today, and we received a 1.55% rate of <br />interest, which is good. <br />3) One member of her staff spent the day beginning to enter the first quarter of the sewer <br />credit issue. In must be complete by May I to get it on the next billing of the Cleveland <br />Division of Water. An electronic list will be provided to them. It is a tedious process as <br />,~ the account code, address and name have to be entered.
