Council Minutes of 4/20/2004 <br />Councilwoman Kasler, chairperson of the Finance Committee: 1) The Finance <br />Committee met on April 13. Present were committee members Kasler, Gazeau and <br />Limpert. Also present were Councilmen Nashaz, Miller and O'Grady; Directors Jesse, <br />Driscoll, Dubelko; the Mayor, City Engineer and guests. Items discussed included: <br />• Ordinance 2004-60, which is an ordinance amending Section 137.01 of Chapter 137 <br />entitled "Department of Law" of the Administrative Code in order to provide for a <br />second law clerk position in the Law Department. The funding for this second law <br />clerk position is being sought through Cleveland State's work-study program. <br />However, it was presented by the Law Director that, should that program not be <br />available for a second law clerk position, the Law Dept. will be able to fund this <br />position out of present appropriations. Thereby, assuring no further costs to the city <br />to fill this position. The committee unanimously recommended the legislation for <br />approval. (Earlier this evening, Law Director Dubelko asked her whether Council <br />would consider passing the legislation under suspension of the rule. President <br />O'Grady asked if there were any objections, and there were none. The legislation <br />will be considered for passage under suspension of the rule.) <br />• Ordinance 2004-61, which is an ordinance amending Section 955.02 of Chapter 955 <br />"Sale of Surplus Personal Property" of the Codified Ordinances of the City of North <br />Olmsted regazding the procedure for sale of surplus property to include <br />authorization to auction surplus property at electronic auction websites. This <br />ordinance calls for the ability and discretion on the pazt of the Service Director to <br />advertise by electronic means, i.e. a-bay, when auctioning old city equipment. All <br />agreed that this additional method of eliminating old equipment could potentially <br />produce more revenue than the traditional auction methods. The Board of Control <br />approves the auctioning of equipment presently, and it would then be within the <br />Service Director's discretion as to which method the sale was most appropriate. The <br />issue of sitting employees potentially purchasing equipment was actually a moot <br />point when it was realized that 1) approval of the auctioning of equipment must go <br />through Board of Control, giving the boazd ultimate determination for what <br />equipment reaches the auction block; 2) the auction would then be blind and open to <br />anyone. The ordinance was unanimously recommended for approval. <br />• Ordinance 2004-68, which is an ordinance authorizing the Mayor to enter into an <br />agreement with Verizon Wireless for the purchase of 30 cell phones and related <br />services for the City of North Olmsted. Discussion ensued regarding 1) the lack of a <br />contract or exhibit with Verizon which is required prior to Council's approval of this <br />ordinance; 2} the cell phone usage within the city and the diverse usage among city <br />employees, which led to; 3) whether there is a city policy regazding cell phone <br />usage. The contract will be produced, but basically addresses 30 phones at no <br />chazge for the phones with a new increase of 800 minutes per month over last yeaz <br />and mobile-to-mobile communications included. The committee has requested that <br />a cell phone policy be produced which emphasizes no personal use of the cell <br />phones. The Service Director stated that examination of the records to establish who <br />the city workers were calling would be time prohibitive, but agreed that a policy <br />should be in place to prohibit personal usage and that spot-checking could be <br />considered. The ordinance was held in committee with the agreement that it would <br />be discussed at a committee meeting prior to the April 20 council meeting if the <br />agreement was produced by that time.
