Councit Minutes of 4/6/2(104 <br />Relations Committee reconvened at 9:08. Present were committee members Kasler, <br />Miller and Limpert; Council members Nashaz, Gareau and McKay; the Law Director and <br />the Planning Director. Agenda items were as follows: <br />• Ordinance 2004-57 which will repeal 2004-17, which through an error was passed <br />without committee review. This ordinance has to do with city contracts. The purpose <br />of this was to increase the number of questions that we would ask conrtractors from 16 <br />to 19. Mr. Jim Burns was in attendance representing the Chamber of Commerce. Mr. <br />Burns noted a chief concern was he didn't believe alt the information was necessary <br />for the process. Also, he had a concern that one piece of information may be used to <br />disqualify a contractor on a particular contract and yet then again not be a concern on <br />another one and not disqualify that individual on a different situation. Mr. Limpert <br />was concerned as to whether a lengthy process might discourage responsible <br />contractors from wanting to get involved. However, he determined that asking three <br />more questions would not be a burden. The committee approved unanimously. <br />• Ordinance 2004-48, to place the Clerk of Commissions and the Assistant Clerk of <br />Commissions under the Planning Director in the form of adding the responsibility of <br />the Assistant Clerk to be the secretary to the Planning Director. This was discussed <br />during budget meetings earlier in the year. It streamlines a situation and places <br />workers where they aze needed without having to expand the number of employees. <br />The committee is requesting suspension of the rules tonight so that the process of <br />hiring can begin and also to avoid additional overtime costs. The committee <br />approved unanimously. <br />Councilman Miller, chairperson of Public Safety, Health & Welfaze Committee: 1) The <br />committee met on Wednesday, Mazch 24. On the agenda were a liquor permit transfer <br />and Ordinances 2004-53 and 2004-54: <br />• The liquor permit transfer for the El Charro site, 30111-17 Lorain Road from Jon Nic <br />Inc. to Larisa LLC at the same address. This is for a D1, D2, D3 and D6 license. The <br />Police Dept. had no objection. The committee recommended to not object to the <br />liquor permit transfer. Councilman Miller moved that Council not object to the liquor <br />license transfer for El Charro. The motion was seconded by Councilman McKay and <br />passed unanimously. <br />• Ordinances 2004-53 and 2004-54. There were numerous citizens in attendance for <br />this discussion. Ordinance 2004-53 is an ordinance amending Section 505.08 of <br />Chapter 505 entitled "Animals and Fowl" in order to prohibit noxious or offensive <br />odors or unsanitary conditions that create a nuisance injurious to the health, safety <br />and public welfare. Ordinance 2004-54 is an ordinance amending Section 505.071 <br />entitled "Animals and Fowl" to provide that deprivation of veterinary medical care <br />may constitute neglect of an animal. Issues of concern with regazd to 2004-53 <br />included how noxious odors would be defined; how would it be determined that <br />noxious odors exist; how would the specific source be determined; could this be used <br />as neighbor against neighbor; how is it handled now? Currently, these types of issues <br />are handled on a complaint basis directed from our Animal Warden on to the County <br />Health Dept. The County Health Dept. then responds. The committee discussed <br />whether or not that response should be placed in our Animal Wazden's list of duties <br />and would it be more timely, would it be more beneficial, and could an employee of <br />4 <br />
