Council Minutes of 2/17/2004 <br />~ Ordinance 2003-164, an ordinance amending Section 741.03 of Chapter 741 of the <br />Business Regulation Code of the City of North Olmsted entitled "Deliveries to <br />Commercial Establishments" so as to prohibit overnight parking of commercial <br />delivery trucks and to amend the hours of operation and declaring an emergency. Mr. <br />Limpert stated some amendments had been proposed in Section (1) D that any large <br />retail store is .50,000 square feet or above, in (B) residential structure is any building <br />designed and used for residential purposes. Section 2, no person shall stop, stand or <br />park a commercial delivery motor vehicle for any length of time between the hours of <br />9 p.m. and 7:30 a.m. in any lot in which is located a large retail store that is within the <br />250 linear feet of a residential structure. Any tenant or owner of a large retail store <br />located within 250 of a residential structure shall post and cause to be posted a sign <br />stating no overnight parking of commercial delivery trucks between 9 p.m. and 7:30 <br />a.m. The height of the sign shall be at eye level. Mr. Burns had a number of <br />concerns. Due to the many concerns, the committee recommended that the ordinance <br />be held in committee as the Law Director and Mr. Burns will work together to <br />address those problems. <br />• Ordinance 2004-12, a resolution dispensing with a RFP process and authorizing the <br />Mayor, following approval by the Board of Control if necessary, to review the service <br />agreement with N. E. Del Giudice Architects, Inc., to serve as back-up plans <br />examiner for the North Olmsted Building Department, and declaring an emergency. <br />The Building Commissioner has requested that the renewal of the agreement with N. <br />E. Del Giudice be passed. Mr. Dailey asked how much the city had paid to the <br />company during the past year. The answer was less than $20,000. The committee <br />recommended approval. <br />• Ordinance 2004-14, an ordinance providing for an amendment of the Zoning Map of <br />the City of North Olmsted by rezoning P. P. Nos. 231-26-005, 231-26-004 and 231- <br />26-003, located immediately to the north of the former Cupachino's building on the <br />northwest corner of Clague Road and Lorain Road, from One Family Residence to <br />General Retail Business. The city planner feels that the rezoning from Single Family <br />Residential to General Retail Business will promote orderly development. By <br />rezoning this to General Retail it becomes more in conformance with the surrounding <br />property. The committee recommended approval. <br />AUDIENCE PARTICIAPTION <br />Dennis Lambert, 25057 Carey Lane. <br />• Thanks to Council for consideration to the Charter Review Commission. He <br />appreciates the opportunity to have been interviewed. <br />• Regarding the Mayor's lawsuit, many controversies have come before this Council in <br />past years that have taken issue and long-term discussion. The President, as <br />chairperson, has the right to maintain decorum. Further, when discussions become of <br />such a large proportion that more than a few minutes commentary is needed, those <br />issues should be stopped and sent to committee. This is a business meeting and the <br />conclusion of what has transpired in committees in the past. He can understand the <br />passion that some Council members have about this issue.
