Council Minutes of 1/20/2004 <br />_.. Larry Orlowski, 4804 Bailey Road <br />• Asked that Council and the administration consider placing brick on the gables of the <br />library rather than vinyl siding. Brick all the way up will give a much better image <br />from Lorain Road. Vinyl siding is not colorfast the sun will bleach the color out. <br />City Engineer Durbin commented that the vinyl siding carries a lifetime guarantee. If it <br />is damaged in any way or fades, it will be replaced by the manufacturer. <br />Dennis Lambert, 25057 Carey Lane <br />• He is in favor of no salting of side streets. It saves money for the city and residents <br />because there is less damage to concrete streets, driveways and garages. <br />Tim Burns, 3978 Dover Center <br />• Mr. McKay is correct that back in the early 1990's he did approach Council about <br />whether or not lottery winnings should be taxed. What precipitated it was an Ohio <br />Supreme Court decision that said, unless city ordinances specifically stated that <br />lottery winnings were to be taxed, they couldn't be taxed. Since then, the state has <br />passed legislation to redefine what is gable income for an individual. Basically, <br />they are saying it is earned income only, specifically exempting lottery and gaming <br />winnings from income tax. <br />LEGISLATION <br />As a point of procedure, Councilman Gareau asked that Ordinance 2004-9 not be passed <br />under suspension of the rules but rather placed on the special Council agenda for second <br />reading and passage. He has checked with the Law Director who agreed that would <br />allow time to address the question of a one or two-year lease. With the consent of <br />Council, President O'Grady announced that Ordinance 2004-9 would be placed on the <br />special Council agenda of Thursday, January 22, 2004. <br />Ordinance No. 2003-177 introduced by Mayor Musial was given its second reading. A <br />resolution authorizing the Mayor to enter into a fourth interim agreement with the City of <br />North Royalton, Ohio, for the stabilization and disposal of biosolids generated by the <br />North Olmsted Wastewater Treatment Plant, and declaring an emergency. <br />Ordinance No. 2004-1 introduced by Councilman Gareau was given its second reading. <br />An ordinance creating new Section 137.03 of Chapter 137 of the Administrative Code, <br />entitled "Department of Law," in order to authorize the Director of Law to settle certain <br />small dollar claims of or against the City of North Olmsted. <br />Ordinance No. 2004-2 introduced by Mayor Musial was given its second reading. An <br />ordinance dispensing with the RFP process otherwise required by Sections 111.03 et seq. <br />of the Administrative Code and authorizing the Mayor to enter into a coYrtract with <br />for the purpose of providing computer consulting services to the city pending <br />appointment of a new Data Processing Commissioner, and declaring an emergency. <br />13 <br />
