Council Minutes of 11/15/2005 <br />Councilman Barker extended congratulations to the Mayor, Law Director, Finance <br />Director, and Councilman Orlowski on winning their elections. Also, congratulations to <br />all those who did not have opponents. Thank you to the residents of Ward 2 for their <br />support of him. Thanks to Mr. Driscoll for his service to the city. He will be missed, <br />Councilman Barker, member of the Building, Zoning and Development Committee: 1) <br />The committee met following Streets & Transportation on Monday, November 14, 2005. <br />In attendance were committee members Barker and Orlowski; Council members Nashar, <br />Miller, Ryan and Tallon; Mayor O'Grady, Law Director Dubelko, Service Director <br />Driscoll, Safety Director Limpert, Finance Director Copfer, P & A Director Farver, <br />Planning Director Wenger and guests. Discussion for this meeting concerned the fencing <br />on the east and south sides of Cornerstone Plaza located at 23420 Lorain Road. The plaza <br />is on the northwest corner of Claque and Lorain. The fence that was approved by city <br />boards and commissions was no longer available when the developer, Mr. Mark <br />Montgomery, ordered the fence for installation. The top of the fence that was approved <br />had loops on the top rail. The fence that arrived had spikes on the top rail, and this is <br />against our codes for safety reasons. Mr. Montgomery cut the spikes off after he was <br />notified by the Building Dept. and tried to have loops made, but that didn't work. The <br />attempt to get a minor change was unsuccessful. He did find a rubber cap to go over <br />what is left from the spikes and, although this is not the original loop approved, it would <br />finish off the top of the fence and be more appealing than it is now. The Planning <br />Commission approved the rubber caps. During the BZD Committee meeting, one <br />committee member and another Council member raised objection to the rubber caps and <br />would like the developer to go back to the fence manufacturer to see if something other <br />than a rubber cap is available. This fence was special ordered, and the manufacturer will <br />not take the fence back. Council members questioned how long the rubber caps will last <br />because of the weather. Also, there was the question of how long will it take the kids to <br />figure out how to remove them, and the owner of the property would most likely have a <br />hard time in keeping up with the missing pieces on a daily basis. The committee decided <br />to hold this in committee until the developer, Mr. Montgomery, comes back to the <br />Planning Director and BZD Committee with other choices to finish off the top of this <br />fence. <br />Councilman Tallon, chairperson of the Finance Committee: 1) The committee met on <br />Monday, November 14. In attendance were committee members Ryan and Tallon; <br />Council President Kennedy; Councilmen Miller, Orlowski, Barker and Nashar; Mayor <br />O'Grady, Finance Director Copfer, Law Director Dubelko, P & A Director Farver, Safety <br />Director Limpert, Councilperson-elect Nicole Dailey Jones. Agenda items were as <br />follows: <br />• Ordinance 2005-154, a transfer ordinance. This ordinance is to make transfers <br />within the budget or, if necessary, to transfer unappropriated funds. The <br />ordinance presented was changed from the original ordinance, and all changes <br />were discussed. After a lengthy and spirited discussion, the committee <br />unanimously recommended passage under suspension of the rule. Councilman <br />Tallon made a motion to amend Ordinance 2005-154 and that it be read on <br />8 <br />
