Council Minutes of 11/1/2005 <br />3) Due to a number of inquiries regarding the 10 Charter amendments which are on the <br />ballot November 8, an informational memorandum was prepared and distributed to the <br />media. <br />4) October 25 and November 1, attended Board of Control and directors' meetings. <br />5) Litigation report: All cases remain status quo except for C & C Realty v. the City of <br />North Olmsted. This is the 2506 appeal from a decision of the Board of Zoning Appeals. <br />A transcript is due in the case on November 18, and briefs are scheduled for January 10, <br />2006 and February 1, 2006. The Prosecutor handled a total of 302 cases in October-236 <br />were traffic; 66 were general offenses. There was one trial and one conviction. <br />Finance Director Copfer: 1) September financial reports have been distributed to Council <br />today. She has not had a chance to review it in its entirety, and she will get back to <br />Council with a quarterly report. To save on paper costs, she would like to distribute these <br />reports by a-mail. <br />2) She received the county's Schedule A which shows the estimated assessed valuation <br />and amount of taxes levied when applying the millage to that assessed valuation. <br />Because of general tangible personal property tax being reduced by $12 million, the <br />assessed valuation, due to the change of the laws at the state level, went down by about <br />$4.5 million, which is .5% in total. The total dollars that will be levied and collected in <br />2005 went down by about $16,000 to $11,448,000. <br />As the listing of delinquent property taxes was in the newspaper, Councilman Miller <br />inquired whether the number was higher than normal. Finance Director Copfer said the <br />county tracks that information, and North Olmsted is estimated to collect 99.5%. This <br />has been pretty consistent except for two years ago when it was down to 98%. <br />Regarding short-term retail establishments, such as Halloween stores, Councilman <br />Gareau said he had asked Mrs. Copfer to check into whether there was a tracking method <br />in place to make sure they are paying all appropriate taxes. The Regional Income Tax <br />Agency does have a method for tracking these establishments. <br />Councilman Nashar, chairperson of the Streets & Transportation Committee: 1) The <br />committee met on October 25. Present were committee members Orlowski and Nashar; <br />Council members Ryan, Miller, Gareau, Barker and President Kennedy; Mayor O'Grady, <br />Law Director Dubelko, Planning Director Wenger; representatives from the Plain Dealer <br />and Chamber of Commerce. Agenda items: <br />• Ordinance 2005-60, which creates new Chapter of 906 of Streets, Utilities, and <br />Public Services Code, entitled "Newsrack Regulations," in order to set standards <br />and regulate the location of newsracks in the public right-of--way and elsewhere <br />within the City of North Olmsted as amended. There was a lengthy discussion. <br />The Planning Director made recommendations of colors, with the brown and <br />bronze color best fitting in with the streetscape plan. Newsrack boxes should <br />meet the following qualifications: height uniform of 48 to 49 inches and <br />consistent in a uniform shape; width may slightly vary to accommodate different <br />sizes of material. A recommended change to reduce the permit fee from $50 to <br />$25 per year was discussed. The Law Director recommended the legislation be <br />4 <br />
