After the public meeting held on <br />September 26, residents were asked to submit their choice of color and design <br />style. Approximately 20 residents returned their requests, with over 52% <br />recommending the sandstone color. It was pointed out by the Law Director that <br />the Mayor has the authority to enter into an agreement with the county and ODOT <br />to complete the planning, engineering and construction. Mayor O'Grady said he <br />would like to review this issue with the county and ODOT. Hopefully, he will be <br />able to report to the committee by November 14. <br />With respect to the newsrack boxes, Councilman Gareau contacted a representative from <br />Developer's Diversified to check on their policy with regard to the boxes located on their <br />property. The representative is looking into that policy, and she will be invited to the <br />follow-up meeting. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />Committee met on October 25. Agenda items included: <br />• Ordinance 2005-152, an ordinance amending Section 351.12 of Chapter 351 <br />(Parking Generally) of the Traffic Code, entitled "All-night Parking Restricted," <br />in order to prohibit parking overnight on tree lawns and berms located <br />immediately adjacent to streets without curbs. This was brought forward in order <br />to provide a more uniform application of the no parking rule from 2 a.m. until 6 <br />a.m. in the city. The Police Dept. is supportive of this legislation. There was <br />discussion as to whether or not there would be a 30-day warning. It was agreed <br />that it would not be written into the code, and it would be left up to the Police <br />Dept., Safety Director and the Mayor to address on a case-by-case basis. It was <br />encouraged that this information be placed on the website and cable channel. It <br />was recommended, and the committee agreed, the new policy would be <br />applicable starting February 1, 2006. The committee unanimously recommended <br />approval as amended with regard to the starting date of February 1, 2006. <br />• A liquor permit stock transfer for Pepper Joes, located at 24532 Lorain Road. <br />This is a D1, D3, D3A and D6 permit. It will be going from the name of <br />Katherine Pishnery to Teresa and Joseph George. The Police Dept. had no <br />objection to the stock transfer, and the committee unanimously recommended not <br />to object. Councilman Miller moved that Council not object to the liquor permit <br />stock transfer for Pepper Joes, 24532 Lorain Road. The motion was seconded by <br />Councilman Ryan and passed unanimously. <br />• Turn lanes at the intersection of south Clague Road and Lorain Road. The issue <br />involved the safety factors in the merge lanes at that location. It was agreed the <br />issue would be referred to the Safety Director and the Engineering Dept. to look <br />at what might be the safest viable changes appropriate for the intersection; and, if <br />any, the Safety Director would then bring back information and input to the <br />,~ committee for possible changes and recommendations. <br />
