Council Minutes of 10/18/2005 <br />• The asphalt program landscaping will be done by the end of this week. <br />• The Americans with Disabilities Act doors that are scheduled to go in at <br />the Senior Center will not be complete this month. The project was <br />delayed due to some confusion with our contractor and a former city <br />employee. The Service Director and representatives of our Building Dept. <br />met with the contractors on October 14. The plans will soon be approved, <br />and we anticipate installation prior to the end of the year. <br />• The sidewalk and steps at the Police Station have been repaired. <br />Law Director Dubelko: 1) October 11, provided legal memorandum to the administration <br />regarding positions at Springvale; provided legal memorandum to Council regarding the <br />Suburban Collision Center issue with respect to the special permit issue discussed at the <br />last Council meeting; attended a director's meeting. <br />2) October 13, provided legal memorandum to the Service Dept. regarding issues relating <br />to bidding of the Clague Road reconstruction project. <br />3) October 14, worked on issues relating to the Fair Housing Review Board including <br />recertification of the city's staff with HUD. <br />4) October 17, attended a safe staffing meeting along with the Finance Director and <br />others at the Fire Dept. <br />5) October 18, attended a directors' meeting. <br />6) Litigation update: <br />• October 12, received a corrected notice from SERB in the matter of the city's <br />unfair labor practice complaint against the city's fire fighters. A determination of <br />probable cause and direction to hearing was issued. The corrected portion was the <br />parties were directed to attempt to mediate before a full hearing is held. <br />• The Charavell case, a NOMBL worker's comp case which had aScott-Ponzer <br />claim element to it against the city's insurer, has been settled by insurance defense <br />counsel. There will be no deductible paid by the city. <br />• The Fiorelli case, involving a NOCOP accident. The city had been dismissed out <br />of that action, but NOCOP remained a party. The insurance counsel settled with <br />NOCOP. There is a deductible involved the insurance company will not pay in <br />the amount of $10,000. It's proposed that that amount will be apportioned <br />between the various communities that participated in NOCOP. <br />• October 17, the city received notice of a lawsuit by the Shelley Company, the <br />contractor on the Lorain Road reconstruction project. The claim is for <br />approximately $47,000 damages regarding what the contractor believes it was <br />entitled to as a result of acceleration of work on the project. That case has been <br />assigned to Judge Callahan. The city's answer is due on or about November 10. <br />• October 17, an award was issued in the holiday pay arbitration matter with the <br />city's fire fighters. This is a grievance by the fire fighters regarding changes in <br />work schedule for staff in the fire prevention bureau and the impact that those <br />changes have on the holidays to which fire fighters are entitled. Arbitrator Ferree <br />decided the case in favor of the fire fighter grievant. No monetary award was <br />given. However, the city is required to go back to the old schedule and permit the <br />fire fighter to have a full holiday even though the work schedule was changed <br />from five eight-hour days to four ten-hour days.
