Council Minutes of 9/28/2005 <br />2) The committee met again on September 19 for cone-half hour long meeting which would <br />be limited to the issue of Suburban Collision Center. At that point, a discussion was <br />undertaken between the Director of Law Dubellco, committee members, and attorney Dan <br />Kolick representing Suburban Collision Centers. An issue was presented to the committee <br />concerning whether or not sufficient findings were presented by the Planning Commission to <br />the BZD Committee and City Council as otherwise would have been required under Section <br />1118.05. This section requires a decision from the Planning Commission to be supported by <br />specific findings for this special use permit. Law Director Dubelko advised, and Council <br />agreed, that because sufficient findings were not included with the Planning Commission <br />recommendation, that the matter would be referred back to the Planning Commission with the <br />request to include 1118.05 findings which would then be referred back to Council for a vote at <br />the next Council meeting. Councilman Gareau made a motion that the Suburban Collision <br />Center proposal and special use permit be referral back to the Planning Commission for <br />findings consistent with its obligations under Section 1118.05. The motion was seconded by <br />Councilman Nashar. Roll call: Gareau, yes; Nashar, yes; Tallon, yes; Orlowski, yes; Ryan, <br />no, commenting he felt it should go back to the committee to be reviewed again so residents <br />have the opportunity to once again see the specific items that are stated. Roll call continued: <br />Barker, yes; Miller, yes. The motion passed with six yes votes and one no vote. <br />Councilman Tallon, chairperson of the Finance Committee: 1) The Finance Committee met <br />on Tuesday, September 13, 2005. In attendance were committee members Talton and Gareau; <br />Council members Nashar, Miller, Barker, Orlowski; the Finance Director, Law Director, <br />Service Director and the City Engineer. Ordinance 2005-130, a transfer ordinance was <br />discussed. The transfer ordinances are the maintenance of the budget. Whereas we are in <br />75% of the budget being spent, there are some housekeeping items to do and those require the <br />transfer of funds. After a lengthy discussion, only a few minor changes were made. The <br />committee unanimously recommended the passage of Ordinance 2005-130 as amended and <br />also for suspension of the rule requiring three readings. <br />2) A special meeting of the Finance Committee was set for 7:30 p.m. on Wednesday, <br />September 28. <br />Councilman Barker, chairperson of the Recreation, Public Parks & Buildings Committee: 1) <br />Councilman Miller, chairperson of the Public Safety Committee, requested that the Recreation <br />Committee take in a few issue$ for discussion. Regarding the Rice recreation report contracts, <br />information on that was received today from Came Copfer. With regard to the fencing issue, <br />on September 14 Council received an e-mail from Safety Director Lirnpert informing that Mr. <br />DiSalvo and Tom Stein contacted Elyria fence and they were supposed to start yesterday on <br />the fence. They did start construction, and it should be completed by the weekend. <br />Councilman Orlowski, chairperson of the Environmental Control Committee: 1) The <br />committee met Tuesday, September 13, regarding Resolution 2005-128, a resolution <br />authorizing the Mayor to submit an application for State of Ohio Issue 2 Infrastructure Bond <br />Program funding for Lessner Road water main replacement and storm sewer construction <br />from Columbia Road to Walter Road and declaring an emergency. City Engineer Durbin <br />presented an approximate cost breakdown for the necessary work and answered questions as <br />to the county road located in North Olmsted. This is a zero percent loan for 20 years. It's also <br />12 <br />
