Council Minutes of 6/21/2005 <br />consistency, then the zoning should stay. Rezoning would create non-government uses <br />and would affect future use of the property to include expansion and future sale. It would <br />create a hardship and would decrease fair market value of the property. He urged <br />Council to amend the Master Plan to maintain the current zoning. Mr. Ward distributed a <br />formal letter addressed to City Council and the Planning Commission which detailed the <br />above objections. <br />Councilman Gareau said this had been discussed at two BZD meetings. The process of <br />updating the Master Plan had used volunteers and focus groups. The end result was the <br />draft that recommended the zoning go to some residential use. The current Master Plan <br />has the same recommendations. The Master Plan is not the rezoning measure. Whether <br />it gets followed will remain to be seen. The 1992 recommendation did not take place. <br />This is not the vehicle to do rezoning. A change in zoning would go to Planning <br />Commission, Council and have a public hearing. We are trying to look out into the <br />future. In the past, some of those things have not been well thought out. This Master <br />Plan is simply arecommendation-a guidepost. <br />Law Director Dubelko said this legislation does not affect a rezone of any property. The <br />Master Plan guides actions of the Planning Commission. The issues listed by Mr. Ward <br />would have to be discussed and looked at during a rezoning issue. <br />Janet Dorn, 30990 Bradley Road. She understands this is a comprehensive plan, but <br />there are errors in the plan. She believes the existing land use map is not correct as three <br />parcels are not marked correctly. Is this spot zoning? There is a parcel being considered <br />for rezoning, and information was passed to an owner. It is like insider trading. <br />Planning Director Wenger came forward and said some of the parcels have multiple uses. <br />The Cuyahoga County tax base was used to see how the parcel was taxed and that is what <br />was used to put the information on the map. <br />Councilman Gareau said the current use map is not how the land is zoned. <br />Councilman Miller said he had difficulties with the Master Plan because of the Bradley <br />Road issue. It may be the best of both worlds for property owners. They may receive <br />more for their land. <br />LEGISLATION <br />Resolution No. 2005-80 introduced by Mayor O'Grady and the entire Council was given <br />its third reading. A resolution approving and adopting the 2005 Master Plan for the City <br />of North Olmsted. Councilman Gareau moved for adoption. The motion was seconded <br />by Councilman Nashar and passed unanimously. Resolution No. 2005-80 adopted. <br />J <br />15 <br />
