Council Minutes of 5/17/2005 <br />and understands the fiustration of trying to deal with the problems. He thinks we ought <br />to be able to do things a little bit better. <br />Dennis Lambert, 25057 Carey Lane, commented again that he believed the Parcel E <br />developer had a contractual relationship with the city. He continues to believe that the <br />developer made a contract with the city when he presented his original plan. By no <br />stretch of the imagination has anybody denied this man his rights. The developer had a <br />chance to present a plan that was more restrictive, but he didn't. So he is using the land <br />exactly the way he wanted to use it. Now, after the dirt is broken, he's making the <br />change. That flies in the face of honor and true commitment to what this whole system is <br />about and what happens. He cannot debate with the Law Director the risks of going into <br />court on these issues as he is the expert. <br />LEGISLATION <br />Ordinance No. 2005-36 introduced by Mayor O'Grady was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into a renewed <br />service contract with Buckeye Power Sales to maintain numerous emergency generators <br />owned by the City of North Olmsted's Waste Water Systems Department, and declaring <br />an emergency. Councilman McKay moved for adoption. The motion was seconded by <br />Councilman Nashar and passed unanimously. Ordinance No. 2005-3b adopted. <br />Resolution No. 2005-44 introduced by Mayor O'Grady was given its third reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for the award of <br />a contract to provide new pavement markings to various streets at various locations in the <br />city as detailed in the specifications on file in the Engineering Department, and <br />authorizing the Mayor, following approval of the Board of Control, if necessary, to <br />contract for the same with the lowest and best bidder, and declaring an emergency. <br />Councilman Nashar moved for adoption. The motion was seconded by Councilman <br />Limpert and passed unanimously. Resolution No. 2005-44 adopted. <br />Ordinance No. 2005-54 introduced by Councilman Gareau was given its third reading. <br />An ordinance amending Section 131.01 of the Administrative Code, entitled "Mayor's <br />Contract Authority, in order to increase the Mayor's limited authority to execute <br />contracts involving t expenditures from two thousand dollars or less to five thousand <br />dollars or less. Councilman Gareau moved for adoption. The motion was seconded by <br />Councilman Nashar and passed unanimously. Ordinance No. 2005-54 adopted. <br />Resolution No. 2005-58 introduced by Councilman Nashar on behalf of Councilman <br />McKay was given its third reading. A resolution calling on the Congress of the United <br />States to reject plans to privatize Social Security by cutting Social Security's guaranteed <br />benefits and diverting money out of Social Security into private investment accounts and, <br />further, calling on Congress to commit to repaying to the Social Security Trust Fund the <br />monies it has taken and spent for other purposes, and declaring an emergency. <br />Councilman McKay moved for adoption, and the motion was seconded by Councilman <br />Nashar.
