Council Minutes of 4/19/2005 <br />claimed injury in a quick stop by a bus on January 20, 2004. Since the operating <br />agreement between the city and RTA was in effect when the accident occurred, RTA <br />will continue to defend the city in this action. <br />• Garson v. City of North Olmsted, a civil action for damages brought by a motorist <br />involved in an accident with a city vehicle. This action has been filed in Common <br />Pleas Court and assigned to Judge Michael Russo. City insurance defense counsel <br />filed an answer on April 11. <br />2) On April 7, he prepared a new contract for the city's art consultant, Sally Julian. It <br />was agreed to by Ms. Julian and signed by both her and the Mayor. The art selection <br />committee is working with Ms. Julian on procuring art for the North Olmsted Library. <br />3) April 7 through April 11, prepared a series of responses to the final several memoranda <br />that were issued by former Mayor Musial in his last several days in office. Most of the <br />responses were provided under the cover of attorney-client privilege b~ause of the <br />sensitivity of the matters involved as well as the fact that the former mayor still has <br />litigation pending against the city. <br />4) April 8, provided written legal advice to the Clerk of Council regarding the legally <br />permissible methods by which the city may publicly advertise proposed Charter <br />amendments. <br />5) April 12 and 19, attended directors' meetings. <br />6) April 12, attended a meeting of the city's Ethics Commission. Reported out to the <br />Ethics Commission on a communication he had with an employee of the Ohio Ethics <br />Commission regarding the benefits of having a local ethics code to resolve "minor" ethics <br />matters in cities throughout the state. It definitely is the opinion of the Ohio Ethics <br />Commission that the state is just not sufficiently staffed or funded to handle every ethics <br />complaint in the state. They see great benefit in having local codes in place to deal with <br />minor ethical violations. Also discussed with the OEC representative the benefits of <br />having a local citizens ethics conunission rather than one whose members are public <br />officials. <br />7) April 13 through 15, spent considerable time preparing an ordinance long-ago <br />requested first by Council Member Kasler and then by both Councilmen Gareau and <br />Miller to regulate news boxes in the public right-of--way. There are some new orange <br />news boxes springing up in the right-of--way around the city. It is a subject that has First <br />Amendment concerns, but there is plenty of case law that gives directions to cities to <br />properly regulate the placement of those boxes in the public right-of--way. <br />8} April 14, attended a meeting of the Cuyahoga County Law Directors' Association. <br />The speaker, long-time law director Margaret Cannon from the cities of Beachwood and <br />Shaker Hts., spoke on the subject of collective bargaining. <br />9) April 14, attended the Charter Review Commission meeting. <br />10) On April 18, attended a meeting of the Fire Dept. Safe Staffing Committee. The <br />committee passed a motion providing that all comments regarding the status of the work <br />of the committee until completed will come from the chairperson, Assistant Fire Chief <br />Robertson. <br />11) On April 18 and 19, received phone complaints from two consumers who wished to <br />file complaints against Kronheim's regarding purchases recently made at the North <br />Olmsted store. He will refer their matters to the City Prosecutor with the request that the <br />® Prosecutor work with the Police Dept. to determine whether or not any of the complaint <br />5 <br />
